Section: If the fast became mandatory for him, but he did not commence it until he became able to afford the Hady (offering), there are two narrations regarding this. One of them is that he is not required to move to the Hady. He said in the narration of al-Marwazi: "If he did not fast during the Hajj, he should fast when he returns," and he does not return to the blood sacrifice, for his obligation has already shifted to the fast; this is because the fast became firmly established in his liability due to its becoming mandatory at the time the cause existed in conjunction with its condition, which is the absence of the Hady. The second [narration] is that he is required to move to it. Ya'qub said: I asked Ahmad about the Mutamatti' (one performing Tamattu') if he does not fast before the day of Sacrifice? He said: "He owes two Hady offerings; he should send them to Mecca." He made the original Hady mandatory upon him, as well as a Hady for delaying the fast beyond its time, because he became able to afford the substitute before he had commenced the substitute, so he is required to move to it, like the one performing Tayammum (dry ablution) when he finds water.
Section: Whoever is obligated to perform the fast of the Mut'ah (Tamattu'), and dies before performing it due to an excuse that prevented him from fasting, there is nothing upon him. If it was for other than an excuse, food should be provided on his behalf, just as food is provided on behalf of the fast of the days of Ramadan. This is because it is a fast that became mandatory by the origin of the Shari'ah, resembling the fast of Ramadan.
672- Issue: He said: "And the woman, when she enters into the state of performing Tamattu', then menstruates and fears missing the Hajj, she should declare the intention for Hajj and become a Qarinah (one performing Qiran), and she is not required to make up the circumambulation of arrival (Tawaf al-Qudum)."
The summary of this is that the Mutamatti'ah (woman performing Tamattu'), if she menstruates before the circumambulation for the 'Umrah, is not permitted to circumambulate the House (Ka'bah); because the circumambulation of the House is a prayer, and because she is prohibited from entering the mosque, and she cannot exit her 'Umrah state until she has circumambulated the House. If she fears missing the Hajj,

فصل: وإن وَجَبَ عليه الصومُ، فلم يَشْرَعْ فيه (٥) حتى قَدَرَ على الهَدْىِ، ففيه رِوَايتانِ: إحْدَاهُما، لا يَلْزَمُهُ الانْتِقَالُ إليه. قال فى رِوَايَةِ المَرُّوذِىِّ (٦): إذا لم يَصُمْ فى الحَجِّ فلْيَصُمْ إذا رَجَعَ. ولا يَرْجِعُ إلى الدَّمِ، وقد انْتَقَلَ فَرْضُه إلى الصيامِ؛ وذلك لأنَّ الصيامَ اسْتَقَرَّ فى ذِمَّتِه، لِوُجُوبِه حَالَ وُجُودِ السَّبَبِ المُتَّصِلِ بشَرْطِه، وهو عَدَمُ الهَدْىِ. والثانية، يَلْزَمُهُ الانْتِقَالُ إليه. قال يعقوبُ: سألتُ أَحمدَ عن المُتَمَتِّعِ إذا لم يَصُمْ قبلَ يومِ النَّحْرِ؟ قال: عليه هَدْيانِ، يَبْعَثُ بهما إلى مَكَّةَ. أوْجَبَ عليه الهَدْىَ الأَصْلِىَّ، وهَدْيًا لِتَأْخِيرِه الصومَ عن وَقْتِه؛ لأنَّه قَدَرَ على المُبْدَلِ (٧) قبلَ شُرُوعِهِ فى البَدَلِ، فلَزِمَهُ الانْتِقَالُ إليه، كالمُتَيَمِّمِ إذا وَجَدَ الماءَ.
فصل: ومن لَزِمَهُ صومُ المُتْعَةِ، فَماتَ قبلَ أن يَأْتِىَ به لِعُذْرٍ مَنَعَهُ (٨) الصومَ، فلا شىءَ عليه. وإن كان لِغَيْرِ عُذْرٍ، أُطْعِمَ عنه، كما يُطْعَمُ عن صومِ أيَّامِ رمضانَ. ولأنَّه صومٌ وَجَبَ بِأصْلِ الشَّرْعِ، أشْبَهَ صومَ رمضانَ.
٦٧٢ - مسألة؛ قال: (والمَرْأَةُ إذَا دَخلَتْ مُتَمَتِّعَةً (١)، فحَاضَتْ، فَخشِيَتْ فَوَاتَ الحَجِّ، أَهَلَّتْ بِالحَجِّ، وكَانَتْ قَارِنَةً، ولَمْ يَكُنْ عَلَيْهَا قَضَاءُ طَوَافِ القُدُومِ)
وجُمْلَةُ ذلك أنَّ المُتَمَتِّعَةَ إذا حَاضَتْ قبلَ الطَّوَافِ لِلْعُمْرَةِ، لم يكنْ لها أن تَطُوفَ بِالْبَيْتِ؛ لأنَّ الطَّوَافَ بِالْبَيْتِ صلاةٌ، ولأنَّها مَمْنُوعَةٌ من دُخُولِ المسجدِ، ولا يُمْكِنُها أن تَحِلَّ من عُمْرَتِهَا ما لم تَطُفْ بِالْبَيْتِ. فإن خَشِيَتْ فَوَاتَ الحَجِّ
