he is able to have it delivered to them, except for someone who has suffered an injury to his head; he distributes it to the poor in the place where he shaved (1).

As for the fidyah (expiation) for injury, it is permissible [to perform it] in the place where he shaved. Ahmad stated this explicitly. Al-Shafi'i said: It is not permissible except in the Haram, due to His saying, the Almighty: "...then its place of sacrifice is at the Ancient House" (2). Our evidence is that the Prophet (peace and blessings of Allah be upon him) commanded Ka'b ibn 'Ujrah regarding the fidyah at al-Hudaybiyah, and did not command him to send it to the Haram (3). Al-Athram and [Abu Ishaq al-Juzjani] (4) narrated in their two books from Abu Asma, the mawla of 'Abdullah ibn Ja'far, who said: I was with 'Uthman, 'Ali, and Husayn ibn 'Ali, may Allah be pleased with them, while on Hajj. Husayn ibn 'Ali complained of illness at al-Suqya, so he gestured with his hand to his head, and 'Ali shaved him and slaughtered a camel for him at al-Suqya. This is the wording of al-Athram's narration. No one was known to have disagreed with them. The verse was revealed regarding the Hady (offering), and the outward meaning of al-Khiraqi's words is that this is specific to the fidyah for shaving hair, while other types of blood sacrifices must be in Mecca. The Qadi said, regarding the blood sacrifices obligatory for committing a forbidden act, such as wearing clothes or applying perfume: They are like the blood sacrifice for shaving. Regarding all of them, there are two narrations: one of them is that he performs the fidyah wherever its cause occurred. The second is that the location for all of them is the Haram. As for the penalty for hunting, it is for the poor of the Haram. Ahmad stated this explicitly, saying: As for what occurred in Mecca, or was of the game (hunted animal), then all of it (5) is in Mecca, because Allah the Almighty said: "...an offering, brought to the Ka'bah" (6). Whatever was of the fidyah for the head, it is wherever he shaved it. The Qadi mentioned another narration regarding the killing of game, that he performs the fidyah where he killed it. This contradicts the text of the Book and the text of Imam Ahmad regarding the distinction between it and shaving the head, so it is not to be relied upon. And whatever became obligatory
