Jabir, who said: 'We used to sacrifice a badana on behalf of seven people.' He was asked: 'And a cow?' He replied: 'Is it not [also] among the camels?' As for a vow, Ibn Aqil said: 'He is obligated by what he intended.' If he made it absolute, then there are two narrations (4) regarding it: One is that a cow suffices for him, due to the report we mentioned. The other is that it does not suffice unless he is unable to obtain a badana. This is the opinion of al-Shafi'i, because it is a replacement, and therefore the unavailability of the replaced item is a condition. The first (5) is preferable due to the report, and because what suffices for seven in the offerings (hady) and the blood sacrifice of tamattu' also suffices in the case of a vow phrased as a badana, such as a full-grown camel (jazur).

Section: It is permissible for seven people to participate in a badana and a cow, whether it is obligatory or voluntary, and regardless of whether all of them intend for it to be an act of drawing near to Allah (qurba), or some of them do while others intend [only] the meat. Malik said: 'Participation in the offering is not permitted.' Abu Hanifah said: 'It is permitted if they are all seeking closeness to Allah (6), but it is not permitted if some of them do not intend the act of devotion.' The hadith of Jabir refutes Malik’s opinion. Our argument against Abu Hanifah is that a sufficient portion (7) does not diminish because a partner intends something other than an act of devotion, so it is permitted, just as if the types of acts of devotion differed, such as if some of them intended tamattu' and others intended qiran. It is permissible for them to divide the meat, because the division is the separation of a right, not a sale.

699- Issue; He said: 'Whatever blood sacrifices become obligatory, nothing suffices except the jadha' (a six-month-old lamb) of sheep and the thaniyy (one that has reached the age of maturity) of other animals.'

This applies to cases other than the retribution for hunting. As for the retribution for hunting, it includes the jafra (a young goat), the 'anaq (a young female goat), the jadhy (a young goat), the healthy, and the defective. As for other than that, such as the offering of tamattu' and others, nothing suffices except the jadha' of sheep, which is one that is six months old, and the thaniyy of others.
