al-Shafi'i. Al-Marwudhi narrated from Ahmad: If he brings the sacrificial animal (hady), then qiran is superior, but if he does not bring it, then tamattu' is superior; this is because the Prophet (peace and blessings of Allah be upon him) performed qiran when he brought the sacrificial animal and forbade everyone who brought the sacrificial animal from leaving the state of ihram until he sacrificed his animal. Al-Thawri and the People of Opinion (Ashab al-Ra'y) held the view of choosing qiran, due to what Anas narrated, saying: I heard the Messenger of Allah (peace and blessings of Allah be upon him) initiate ihram for both together, saying: "Labbayk for 'Umrah and Hajj, Labbayk for 'Umrah and Hajj." Agreed upon. And the hadith of al-Dabbi ibn Ma'bad, when he recited talbiyah for both, then came to 'Umar and asked him, and he said: "You have been guided to the sunnah of your Prophet (peace and blessings of Allah be upon him)." It is narrated from Marwan ibn al-Hakam that he said: "I was sitting with 'Uthman ibn 'Affan when he heard 'Ali reciting talbiyah for 'Umrah and Hajj. He sent for him and asked, 'Did we not forbid this?' He replied, 'Yes, but I heard the Messenger of Allah (peace and blessings of Allah be upon him) reciting talbiyah for both together, and I would not abandon the word of the Messenger of Allah (peace and blessings of Allah be upon him) for your word.'" Recorded by Sa'id. This is because qiran is a haste towards performing the act of worship and is an entry into the state of ihram for both rituals from the miqat, and it contains an additional ritual, which is the dam (offering a sacrifice), so it is worthier. Malik and Abu Thawr held the view of choosing ifrad. This is the apparent view in the madhhab of al-Shafi'i. This is also narrated from 'Umar, 'Uthman, Ibn 'Umar, Jabir, and 'A'ishah; because 'A'ishah and Jabir narrated that the Prophet (peace and blessings of Allah be upon him) performed ifrad for Hajj. Both are agreed upon. And from Ibn 'Umar and Ibn 'Abbas, the same is narrated. Agreed upon.
