then let him hire himself out with his food and what follows it, until he completes his rituals. According to Malik: If walking is possible for him, and his habit is to ask of people, Hajj becomes incumbent upon him; because this is ability in his case, so he is like one who possesses provisions and a mount. Our view is that the Prophet (peace and blessings of Allah be upon him) interpreted ability as provisions and a mount, so it is necessary to return to his interpretation. Al-Daraqutni (9) narrated, with his chain of authority from Jabir, Abdullah ibn Umar, Abdullah ibn Amr ibn al-As, Anas, and Aishah, may Allah be pleased with them all, that the Prophet (peace and blessings of Allah be upon him) was asked: What is the way? He said: "Provisions and a mount." Ibn Umar also narrated, saying: A man came to the Prophet (peace and blessings of Allah be upon him) and said: O Messenger of Allah, what makes Hajj incumbent? He said: "Provisions and a mount." Narrated by al-Tirmidhi (10), who said: A hasan (good) hadith. Imam Ahmad also narrated, informing us that Hushaym narrated from Yunus, from al-Hasan, who said: When this verse was revealed: {And [due] to Allah from the people is a pilgrimage to the House - for whoever is able to find thereto a way} (11), a man said: O Messenger of Allah, what is the way? He said: "Provisions and a mount" (12). Furthermore, because it is an act of worship that involves traversing a long distance, provisions and a mount were stipulated for its obligation, just like jihad. What they mentioned is not [actual] ability, for it is arduous, even if it is customary; and the consideration is for general circumstances, not specific ones, just as travel concessions apply generally to those for whom it is arduous and those for whom it is not.

Section: Hajj is not incumbent upon him by another offering it to him, nor does he become capable of it through that, whether the one offering it is a relative or a stranger, and whether he offered him the ride and provisions or offered him wealth. According to al-Shafi'i, if his child offers him what enables him to perform Hajj, it becomes incumbent upon him; because Hajj is possible for him without a burden he is obligated to bear, and no harm attaches to him, so Hajj becomes incumbent upon him, just as if he owned the provisions and the mount. Our view is that the statement of the Prophet (peace and blessings of Allah be upon him) that what makes Hajj incumbent is "provisions and a mount" requires the stipulation of owning that,
