Section: As for tawliya (transfer) and shirka (partnership) regarding that which it is permissible to sell, both are permissible because they are two types of sale, distinguished only by names, just as the sale of murabaha (cost-plus profit) and muwada'a (sale at a loss) are distinguished by names. If one buys something and a man says to him: "Make me a partner in half of it for half the price," and he replies: "I have made you a partner," it is valid, and it becomes a partnership between them. If he says: "Transfer to me what you have bought for the price," and he says: "I have transferred it to you," it is valid, provided the price is known to both of them. If one of them is ignorant of it, it is not valid, just as if he had sold it by the number [of the price tag]. If he says: "Make me a partner in it," or says: "The partnership in it," and he replies: "I have made you a partner," or says: "Transfer to me what you have bought," without mentioning the price, it is valid if the price is known, because partnership implies the purchase of a part of it for its share of the price, and tawliya implies buying it for the like of the price, so when the term is used absolutely, it refers to that, just as if one said: "Cancel the sale for me," and he replied: "I have cancelled it for you." In a hadith from Zuhra ibn Ma'bad, [he used to go out] (3) with his grandfather (4) Abdullah ibn Hisham to the market, and he would buy food. Ibn Umar and Ibn al-Zubayr would meet him and say to him: "Make us partners, for the Prophet (peace and blessings of Allah be upon him) prayed for barakah (blessing) for you." So he would make them partners, and sometimes he would acquire a camel just as it was, and send it to his house. Al-Bukhari mentioned this (6). If he bought something and a man said to him: "Make me a partner," and he made him a partner (7), it refers to half of it, because it implies equality when used absolutely. If two people bought a slave and entered into a partnership regarding him, and a man said to them: "Make me a partner in him," and they said: "We have made you a partner," it is possible that he receives half; because if their partnership (8) was with each of them separately, he would have had half, so it is the same

فصل: وأمَّا التَّوْلِيَةُ والشَّرِكَةُ فيما يَجوزُ بَيْعُه فجائِزانِ، لأنَّهما نَوْعانِ من أَنْواعِ البَيْعِ، وإنَّما اخْتَصَّا بأسْماءٍ، كما اخْتَصَّ بَيْعُ المُرَابَحَةِ والمُوَاضَعَةِ بأسْماء. فإذا اشْتَرَى شَيْئًا فقال له رَجُلٌ: أشْرِكْنِى فى نِصْفِه بِنِصْفِ الثَّمَنِ. فقال: أشْرَكْتُكَ. صَحَّ، وصارَ (١) مُشْتَرَكًا بينهما. وإنْ قال: وَلِّنِى ما اشْتَرَيْتَه بالثَّمَنِ فقال: وَلَّيْتُكَ. صَحَّ، إذا كان الثَّمَنُ مَعْلُومًا لهما. فإنْ جَهِلَهُ أحَدُهما، لم يَصِحَّ، كما لو باعَه بالرَّقَمِ. ولو قال: أشْرِكْنِى فيه. أو قال: الشَّرِكَةُ فيه (٢). فقال: أشْرَكْتُكَ. أو قال: وَلِّنِى ما اشْتَرَيْت. ولم يَذْكُرِ الثَّمَنَ، صَحَّ إذا كان الثَّمَنُ مَعْلُومًا؛ لأنّ الشَّرِكَةَ تَقْتَضِى ابْتِياعَ جُزْءٍ منه بقِسْطهِ من الثَّمَنِ، والتَّوْلِيَةَ ابْتِياعَه بمثلِ الثَّمَنِ، فإذا أُطْلِق اسمُه انْصَرَفَ إليه، كما لو قال: أقِلْنِى. فقال: أقَلْتُكَ. وفى حَدِيثٍ عن زُهْرَةَ ابن مَعْبَدٍ، [أنَّه كان يَخْرُجُ] (٣) به جَدُّه (٤) عبدُ اللَّه بن هِشَامٍ إلى السُّوقِ، فيَشْتَرِى الطَّعَامَ، فيَلْقاهُ (٥) ابنُ عمرَ وابنُ الزُّبَيْرِ، فيقولانِ له: أشْرِكْنَا، فإنَّ النَّبِيَّ -صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ- دَعَا لك بالبَرَكَةِ. فَيُشْرِكُهُم، فربَّما أصَابَ الرَّاحِلَةَ كما هى، فيَبْعَث بها إلى المَنْزِلِ. ذكره البُخارِيُّ (٦). ولو اشْتَرَى شَيْئًا، فقال له رَجُلٌ: أشْرِكْنِى. فشَرَكَهُ (٧)، انْصَرَفَ إلى نِصْفِه؛ لأنّها بإطْلاقِها تَقْتَضِى التَّسْوِيَةَ. فإنْ اشْتَرَى اثْنانِ عَبْدًا، فاشْتَركا فيه، فقال لهما رَجُلٌ: أشْرِكانِى فيه. فقالا: أشْرَكْناكَ. احْتَملَ أنْ يكونَ له النِّصْفُ؛ لأنَّ اشْتِرَاكهُما (٨) لو كان من كلِّ واحدٍ منهما مُنْفَرِدًا كان له النِّصْفُ، فكذلك
