and sharecropping (muzara'a). The manifest view is that they are both permissible, so no option enters into them. It has been said: they are both binding, so there are two views regarding the establishment of the option in them. [As for] shooting competitions and racing (al-sabq wa al-ramy), the manifest view is that they are contracts of hiring for a specific task (ja'ala), so no option is established in them. It has also been said that they are a lease (ijara), and the mention of that has already passed. The sixth category is a contract that is binding and independently carried out by one of the two contracting parties, such as the transfer of debt (hawala) and the exercise of pre-emption (shuf'a); there is no option in them, because the one whose consent is not considered has no option. If the option is not established in one of its two sides, it is not established in the other, like all other contracts. It is possible that the option is established for the transferor (muhil) and the pre-emptor (shafi'); because it is an exchange in which compensation is intended, so it resembles other forms of sale.
والمُزَارَعَةِ، والظَّاهِرُ أنهما جائزانِ، فلا يَدْخُلُهُما خِيَارٌ. وقد قِيلَ: هما لَازِمَانِ، ففِي ثُبُوتِ الخِيَارِ فيهما وَجْهانِ، والسَّبْقِ والرَّمْي، والظَّاهِرُ أنهما جَعالَةٌ، فلا يَثْبُتُ فيهما خِيَارٌ. وقِيلَ: هما إجارَةٌ، وقد مَضَى ذِكرُها. الضَّرْبُ السَّادِسُ، لَازِمٌ يَسْتَقِلُّ به أحَدُ المُتَعَاقِدَيْنِ، كالحَوَالَةِ، والأخْذِ بِالشُّفْعَةِ، فلا خِيَارَ فيهما؛ لأنَّ مَنْ لا يُعتَبرُ رِضاهُ لا خِيَارَ له. وإذا لم يَثْبُتْ في أحَدِ طَرَفَيْهِ لم يَثْبُتْ في الآخَرِ، كسَائِرِ العُقُودِ. ويَحتَمِلُ أن يَثْبُت الخِيَارُ لِلمُحِيلِ والشَّفِيعِ؛ لأنها مُعاوَضَةٌ يُقْصَدُ فيها العِوَضُ، فَأشْبَهَتْ سائرَ البَيْعِ.
