"Then [it is not permitted] at all." He forbade it and reasoned that it decreases when it dries. Malik (6) narrated from Nafi', from Ibn 'Umar, that the Messenger of God - may God bless him and grant him peace - forbade al-muzabanah (the sale of untracked fruit for measured fruit). Al-muzabanah is the sale of fresh dates for dried dates by measure, and the sale of grapes for raisins by measure. This is because it is a genus in which riba (usury) applies, and some of it is sold for some of it in a manner where one of them is uniquely prone to decrease; therefore, it is not permissible, like the sale of roasted for raw. The hadith does not mandate [the prohibition of selling] old for old because the disparity is slight. Al-Khattabi (7) said: Some people have spoken about the chain of transmission of the hadith of Sa'd ibn Abi Waqqas regarding the sale of fresh dates for dried dates, and said: Zayd, the mawla (freed slave) of Abu 'Ayyash, its narrator, is weak. The matter is not as they imagined; Abu 'Ayyash, the mawla of Banu Zuhrah, is well-known, and Malik has mentioned him in "al-Muwatta'", and he does not narrate from one whose hadith is abandoned.

Section: As for the sale of fresh dates for fresh dates, grapes for grapes, and similar produce of the same kind, it is permissible with equality according to the opinion of most scholars. Al-Shafi'i forbade it in things that dry. As for what does not dry, such as cucumbers, squash, and the like, there are two opinions; because their equality is not known at the time of storage, so it resembles [the case of] fresh dates (8) for dried dates. Abu Hafs al-'Ukbari, one of our companions, went with this [view] and interpreted the words of al-Khiraqi accordingly, because of his statement regarding meat: It is not permissible to sell some of it for some of it while it is fresh.
