seven nights and eight days [Surah Al-Haqqah: 7]. If he says, 'Give him a ba'ir (camel),' there are two opinions regarding it: one is that it refers solely to the male, because in custom, this name belongs exclusively to him. The second is that it refers to both the male and female, because in the language of the Arabs, it encompasses both. The Arabs say, 'I milked the ba'ir,' intending the female camel. The jamal (male camel) in their language is like the man among the children of Adam, the naqah (she-camel) is like the woman, the bakrah is like the young woman, and likewise the qalus and the ba'ir are like the human being.

Section: If he bequeaths to him a thawr (bull), it is a male. If he bequeaths to him a baqarah (cow), it is a female. If he bequeaths a dabbah (beast of burden), it is one of the horses, mules, or donkeys, and it encompasses both the male and the female, because the name in custom applies to all of them. If he associates with it something that directs it to one of the two, such as if he says, 'a dabbah that he fights upon,' or 'has shares [in the war booty],' it is directed to horses. If he says, 'a dabbah whose back and offspring one benefits from,' the mules are excluded because they have no offspring, and the males are likewise excluded. If he bequeaths to him a himar (donkey), it is a male. If he bequeaths an atan (female donkey), it is a female. In all of these cases, if he has numbers of the type he bequeathed, then according to the statement of al-Khiraqi, he receives that by lottery (qur'ah). According to the narration of Ibn Mansur, the heirs give him whatever they wish. He does not have a claim to a saddle (sarj) for the beast or a pack-saddle (rahl) for the camel, unless he mentions it in the bequest.

Section: If he bequeaths a dog whose possession is permissible, the bequest is valid because there is permissible benefit in it, and possession is recognized over it. A bequest is an act of charity, so it is valid regarding wealth and regarding rights other than wealth; furthermore, its gifting is valid, so its bequest is valid, like property. If it is of the type whose possession is not permissible, the bequest is not valid, whether he says 'a dog from my dogs' or 'from my wealth,' because it is not valid to sell a dog, as it has no value, unlike a sheep. If he has a dog and no other wealth besides it, he is entitled to a third of it. And
