for the paternal aunts; because they are in the position of the father, so the daughters of brothers are excluded by them; because they are in the position of brothers. It is possible that the children of brothers and sisters are made to be from the category of paternity, so the child of the parents [both parents] and the child of the father are prioritized over the paternal aunts; because they are the children of his son, and the paternal aunts are his sisters. The aspect of this possibility is that when we make brotherhood one category and paternity another category, along with what has been established in our school that if the distant relative and the near relative are from two different categories, the distant one is adjusted [downwards] until it reaches its heir, regardless of whether the near relative is excluded by it or not; it follows necessarily from this that the children of brothers are excluded by the daughters of the paternal uncle from the mother; because they are from the category of the father. And it follows from this that they are excluded by the daughters of the paternal aunts, and the daughters of all paternal uncles. As for if in the place of the paternal aunts and maternal aunts there were their daughters, then for the maternal aunts is the one-sixth, divided among their daughters into five, and the remainder is for the daughters of the brothers; for the daughter of the brother from the mother is the one-sixth, and the remainder is for the daughter of the brother from both parents, and the issue is valid from thirty. If there are no daughters of brothers from both parents, nor from a father, then the remainder is for the daughter of the paternal uncle from both parents.

Section: A maternal aunt and a daughter of a paternal aunt; for the maternal aunt is the one-third, and the remainder is for the daughter of the paternal aunt.
