فصل: في عَمَّاتِ الأبوَيْنِ وأخوالِهما وخالاتِهما؛ مذهبُنا ما تقدَّمَ من تقديمِ الأسْبَقِ إلى الوارِثِ ان كانا من جِهَةٍ واحدةٍ، وتنْزيلِ البعيدِ حتى يَلْحَقَ بوارثِهِ إنْ كانا من جِهَتَيْنِ، ثم يُجْعَلُ لمَنْ يُدْلِى به ما كانَ لهُ. وأكْثرُ المُنَزِّلِينَ يُعْطونَ الميراثَ للأسْبَقِ بكلِّ حالٍ. والمشهورُ عن أهلِ العراقِ أنَّ نصيبَ الأُمِّ بين خالِها وخالتِها، وعَمِّها وعمَّتِها، على ثلاثةٍ، ونصيبَ الأبِ بين عَمَّاتِهِ وخالاتِهِ كذلك.
ومن مسائلِ ذلك؛ ثلاثُ خالاتِ أُمٍّ مُفْتَرِقاتٍ وثلاثةُ أعمامِ أُمٍّ مُفْتَرِقينَ وثلاثُ خالاتِ أبٍ مُفتَرِقاتٍ، فخالاتُ الأُمِّ بمنزِلَةِ أُمِّ الأُمِّ، وخالاتُ الأبِ بمنزِلَةِ أُمِّ الأبِ، فيكونُ المالُ بين هاتينِ الجَدَّتينِ نصفَيْنِ، ونصيبُ كلِّ واحدةٍ منهما بَيْنَ أخواتِها على خمسةٍ، وتسقُطُ عَمَّاتُ الأُمِّ؛ لأنَّهنَّ بمنزِلَةِ أبى (٥) الأُمِّ، وهو غيرُ وارثٍ. فإن كانَ معهم عَمَّاتُ أبٍ، فلخالاتِ الأبِ والأُمِّ السُّدُسُ بَيْنَهما، والباقى لعَمَّاتِ الأبِ؛ لأنَّهنَّ بمنزِلَةِ الجَدِّ. عَمَّةُ أبٍ وعَمَّةُ أُمٍّ، لعَمَّةِ الأُمِّ الثُّلُثُ، والباقى لعَمَّةِ الأبِ. هذا قياسُ المذهبِ، وهو قولُ أهلِ
