Chapters on the Correction of Issues
If the shares of a group of heirs cannot be divided among them in a correct division, multiply their number by the origin of the issue and its 'awl (increase), if it is a case of 'awl. Unless their number corresponds to their shares by a half, a third, or any other fractional part, in which case it is sufficient for you to multiply the concordance of their number by the origin of the issue and its 'awl if it is a case of 'awl; what results is the figure from which it becomes correct. If you wish to perform the division, every person who has a share from the origin of the issue multiplied by the number you multiplied into the issue—which is what is called the 'share part' (juz' al-sahm)—the result is what they receive if they are one person. If they are a group, divide it among them. If you wish, you may say: if the fractional remainder exists against one group, then for one of them after the correction is the same as what their group had before the correction, or its concordant part if it corresponds. An example of this is a husband, a mother, and three brothers. Its origin is six; the husband has a half, which is three; the mother has a sixth, which is one share; two shares remain for the brothers, which cannot be divided among them, nor do they correspond to them. Therefore, multiply their number, which is three, by the origin of the issue; it becomes eighteen shares. The husband has three times three, which is nine; the mother has one share times three, which is three; the brothers have two shares times three, which becomes six, meaning each one of them has two shares. If there were six brothers, their shares would correspond to them by a half, so you reduce them to their half, which is three, and perform the same calculation as you did in the first case; each of the brothers has one share, which is the concordant part of their group's shares.
Section: If the fractional remainder exists against two groups, it will necessarily fall into one of four categories; the first of which is that...
