grandmothers, two from the father’s side and one from the mother’s side. This was reported by Abu ‘Ubayd and al-Daraqutni. Sa‘id also reported from Ibrahim that he said: They used to grant inheritance to three grandmothers, two from the father’s side and one from the mother’s side. This indicates the limitation to three, and that no more than them inherit. Once this is established, the inheritors are the mother of the mother, however high her degree may be, the mother of the father and his mothers, however high their degree may be, and the mother of the grandfather and his mothers. The mother of the father of the grandfather does not inherit, nor does any grandmother who is related through more than three ancestors. These are the grandmothers about whom there is a disagreement. Scholars are in consensus that a grandmother who is related through a non-inheriting father does not inherit; she is any grandmother who is related through a father between two mothers, such as the mother of the father of the mother, except for what was narrated from Ibn ‘Abbas, Jabir ibn Zayd, Mujahid, and Ibn Sirin, who said: She inherits. This is a rare (shadh) opinion, and we know of no one in our time who holds it, and it is not correct; for she is related through a non-inheriting father, so she does not inherit, like outsiders. Examples of this are: mother of a mother and mother of a father, they receive the sixth (al-sudus) by consensus. The mother of the mother of a mother, the mother of the mother of a father, the mother of the father of a father, and the mother of the father of a mother: the sixth is for the first three, except according to Malik and those who agree with him, for it is for the first two. According to Dawud, it is for the first only. The fourth does not inherit except in a rare opinion from Ibn ‘Abbas and his adherents. The mother of the mother of a mother of a mother, the mother of the mother of a mother of a father, the mother of the mother of the father of a father, the mother of the father of the father of a father, the mother of the mother of the father of a mother, the mother of the father of a mother of a mother, the mother of the father of a father of a mother, and the mother of the father of a mother of a father: the sixth is for the first according to Dawud, for the first two according to Malik and those who agree with him, and for the first three
