170 - Zakariyya ibn Yahya narrated to me, saying: Abu Talib narrated to us, [that he] heard Abu Abd Allah [Ahmad ibn Hanbal] say: 'If he turns away, let him go and do not pursue him.' It was said to him: 'If he takes my wealth and leaves, should I pursue him?' He replied: 'If he takes your wealth, then pursue him; the Prophet (peace and blessings of Allah be upon him) said: "Whoever fights to protect his wealth [is a martyr]." So you are seeking your wealth. If he throws it to you, then do not pursue him and do not strike him; let him go. But if he does not throw it to you and you strike him, while you do not intend to kill him—you only intend to take back your property and defend yourself—then if he dies, there is nothing upon you; because you are only fighting to protect your wealth.' [He referred to] the hadith of Imran ibn Husayn regarding the thief, meaning he saw no harm upon the one who killed him, so he mentioned it. And Ibn Umar, when a thief entered, he went out running with his sword drawn.
١٧٠ - حَدَّثَنِي زَكَرِيَّا بْنُ يَحْيَى، ثَنَا أَبُو طَالِبٍ، سَمِعَ أَبَا عَبْدِ اللَّهِ، قَالَ: «فَإِنْ وَلَّى فَلْيَدَعْهُ وَلَا يَتَّبِعْهُ» ، قِيلَ لَهُ: فَإِنْ أَخَذَ مَالِي وَذَهَبَ أَتَّبِعُهُ؟ قَالَ: " إِنْ أَخَذَ مَالَكَ فَاتَّبِعْهُ، قَالَ النَّبِيُّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: مَنْ قَاتَلَ دُونَ مَالِهِ، فَأَنْتَ تَطْلُبُ مَالَكَ، فَإِنْ أَلْقَاهُ إِلَيْكَ فَلَا تَتَّبِعْهُ، وَلَا تَضْرِبْهُ، دَعْهُ يَذْهَبْ، وَإِنْ لَمْ يُلْقِهِ إِلَيْكَ ثُمَّ ضَرَبْتَهُ، وَأَنْتَ لَا تَنْوِي قَتْلَهُ، إِنَّمَا تُرِيدُ تَأْخُذُ شَيْئَكَ وَتَدْفَعُهُ عَنْ نَفْسِكِ، فَإِنْ مَاتَ فَلَيْسَ عَلَيْكَ شَيْءٌ؛ لِأَنَّكَ إِنَّمَا تُقَاتِلُ دُونَ ⦗١٧٤⦘ مَالِكَ. حَدِيثُ عِمْرَانَ بْنِ حُصَيْنٍ فِي اللِّصِّ، يَعْنِي فَلَمْ يَرَ بَأْسًا عَلَى قَاتِلِهِ، فَذَكَرَهُ، وَابْنُ عُمَرَ قَدْ دَخَلَ لِصٌّ، فَخَرَجَ يَعْدُو بِالسَّيْفِ صَلْتًا "
