until she speaks the testimony of Islam. If she says, "There is no god but Allah," he shall establish her purity (istibra') with one menstrual cycle, unless she is pregnant, in which case he shall abstain from her until she delivers.
Yahya narrated from al-Mu'alla, from Uthman al-Batti, from Abu al-Khalil, from Abu Sa'id al-Khudri who said: "We took captives on the day of Awtas whose lineages and husbands were known, so we refrained from them. Then this verse was revealed: 'And the married women from among women, except what your right hands possess,' referring to the captives." "The ordinance of Allah upon you" means: your mothers, daughters, and sisters have been prohibited to you up to this point. Then He says: "The ordinance of Allah upon you," meaning: by the prohibition of what has been mentioned.
Muhammad said: "The ordinance (kitab) of Allah" is in the accusative case (mansub) based on the meaning: "He has ordained for you an ordinance." "Lawful to you are all beyond those mentioned" means: those women who are after those mentioned. "That you seek [them] with your wealth" means: that you marry them with your wealth; no one shall marry more than four.
حَتَّى تَتَكَلَّم بِالْإِسْلَامِ فَإِذا قَالَت: لَا إِلَه إِلَّا الله، استبرأها بِحَيْضَة، إِلَّا أَن تكون حَامِلا؛ فيكف عَنْهَا، حَتَّى تضع.
يَحْيَى: عَنِ الْمُعَلَّى، عَنْ عُثْمَانَ الْبَتِّيِّ، عَنْ أَبِي الْخَلِيلِ، عَنْ أَبِي سَعِيدٍ الْخُدْرِيِّ قَالَ: ((أَصَبْنَا يَوْمَ أَوْطَاسٍ سَبَايَا نَعْرِفُ أَنْسَابَهُنَّ وَأَزْوَاجَهُنَّ، فَامْتَنَعْنَا مِنْهُنَّ؛ فَنَزَلَتْ هَذِهِ الآيَةُ: ﴿وَالْمُحْصَنَاتُ مِنَ النِّسَاءِ إِلا مَا ملكت أَيْمَانكُم﴾ من السبايا)). ﴿كتاب الله عَلَيْكُم﴾ يَعْنِي: حرمت عَلَيْكُم أُمَّهَاتكُم وبناتكم وأخواتكم إِلَى هَذَا الْموضع، ثمَّ قَالَ: كتاب الله عَلَيْكُم؛ يَعْنِي: بِتَحْرِيم مَا قد ذكر.
قَالَ مُحَمَّد: ﴿كتاب الله﴾ مَنْصُوب على معنى: كتب عَلَيْكُم كتابا. ﴿وَأُحِلَّ لَكُمْ مَا وَرَاءَ ذَلِكُم﴾ يَعْنِي: مَا بعد ذَلِكُم من النِّسَاء. ﴿أَن تَبْتَغُوا بأموالكم﴾ تتزوجوا بأموالكم؛ لَا يتَزَوَّج فَوق أَربع.
