1524 - Abu Zur'ah narrated to us, Muhammad ibn Sa'id al-Asbahani narrated to us, Sharik informed us, from Salim, from Sa'id ibn Jubayr, regarding His saying: "But if one is forced by necessity, without being disobedient nor transgressing," he said: One who commits highway robbery; there is no concession for him when he is hungry to eat dead meat, and when he is thirsty to drink wine.
The Second Perspective:
1525 - Abu Zur'ah narrated to us, Yahya ibn 'Abd Allah ibn Bukayr narrated to us, 'Abd Allah ibn Lahi'ah narrated to me, 'Ata' ibn Dinar narrated to me, from Sa'id ibn Jubayr, regarding the saying of Allah: "Without being disobedient (baghin)," meaning: without declaring it lawful. It is reported from Muqatil ibn Hayyan something similar.
The Third Perspective:
1526 - Abu Zur'ah narrated to us, 'Amr ibn Hammad narrated to us, Asbat narrated to us, from al-Suddi: "But if one is forced by necessity, without being disobedient," as for "baghin" (disobedient), it means he seeks it out of desire.
1527 - 'Isam ibn Rawwad narrated to us, Adam narrated to us, Damrah narrated to us, from 'Uthman ibn 'Ata', from his father, regarding His saying: "But if one is forced by necessity, without being disobedient," he said: He should not roast the dead meat to satisfy his desire, nor cook it, and he should not eat anything but enough to sustain life, and he should carry with him what will bring him to that which is lawful, and once he reaches it, he should discard it.

[The First Perspective]
It is mentioned from Muhammad ibn Rabi'ah, from Salamah ibn Sabur, from 'Atiyyah, from Ibn 'Abbas, regarding His saying: "Without being disobedient nor transgressing," he said: Without being disobedient regarding the dead meat, and not transgressing in his eating of it.
1528 - Abu Sa'id al-Ashajj narrated to us, Abu Khalid narrated to us, from al-Hajjaj, from al-Qasim, from Mujahid, "without being disobedient nor transgressing," he said: The transgressor ('adin) is the one who terrifies [those on] the path. It is reported from Sa'id ibn Jubayr something similar.
The Second Perspective:
1529 - Abu Zur'ah narrated to us, 'Amr ibn Hammad narrated to us, Asbat narrated to us, from al-Suddi: As for "transgressing," he transgresses in his eating of it by eating until he is full; rather, he should eat only the sustenance that will sustain his life until he fulfills his need.
1530 - Abu Zur'ah narrated to us, al-Hasan ibn 'Amr ibn 'Awn al-Bahili narrated to us, Yazid ibn Zuray' narrated to us, Sa'id narrated to us, from Qatadah, regarding His saying: "But if one is forced by necessity, without being disobedient nor transgressing," in his eating, that he does not transgress from the lawful to the unlawful while he finds a way out from it.
١٥٢٤ - حَدَّثَنَا أَبُو زُرْعَةَ، ثنا مُحَمَّدُ بْنُ سَعِيدٍ الأَصْبَهَانِيُّ، أَنْبَأَ شَرِيكٌ، عَنْ سَالِمٍ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ، فِي قَوْلِهِ: فَمَنِ اضْطُرَّ غَيْرَ بَاغٍ وَلا عَادٍ قَالَ: الَّذِي يَقْطَعُ الطَّرِيقَ، فَلا رُخْصَةَ لَهُ إِذَا جَاعَ، أَنْ يَأْكُلَ الْمَيْتَةَ وَإِذَا عَطِشَ أَنْ يَشْرَبَ خَمْرًا.

١٥٢٥ - حَدَّثَنَا أَبُو زُرْعَةَ، ثنا يَحْيَى بْنُ عَبْدِ اللَّهِ بْنِ بُكَيْرٍ، حَدَّثَنِي عَبْدُ اللَّهِ بْنُ لَهِيعَةَ، حَدَّثَنِي عَطَاءُ بْنُ دِينَارٍ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ، فِي قَوْلِ اللَّهِ: غَيْرَ بَاغٍ يَعْنِي:
غَيْرَ مُسْتَحِلٍّ. وَرُوِيَ عَنْ مُقَاتِلِ بْنِ حَيَّانَ نَحْوُ ذَلِكَ.
وَالْوَجْهُ الثَّالِثُ:
١٥٢٦ - حَدَّثَنَا أَبُو زُرْعَةَ، ثنا عَمْرُو بْنُ حَمَّادٍ، ثنا أَسْبَاطٌ، عَنِ السُّدِّيِّ فَمَنِ اضْطُرَّ غَيْرَ بَاغٍ أَمَّا بَاغٍ: فَيَبْغِي فِيهِ بِشَهْوَتِهِ.
١٥٢٧ - حَدَّثَنَا عِصَامُ بْنُ رَوَّادٍ، ثنا آدَمُ، ثنا ضَمْرَةُ، عَنْ عُثْمَانَ بْنِ عَطَاءٍ، عَنْ أَبِيهِ، قَوْلُهُ: فَمَنِ اضْطُرَّ غَيْرَ بَاغٍ قَالَ: لَا يَشْوِي مِنَ الْمَيْتَةِ لِيَشْتَهِيَهُ، وَلا يَطْبُخْهُ وَلا يَأْكُلْ إِلا الْعُلْقَةَ، وَيَحْمِلُ مَعَهُ مَا يُبَلِّغُهُ الْحَلالَ فَإِذَا بَلَغَهُ ألقاه.

ذُكِرَ عَنْ مُحَمَّدِ بْنِ رَبِيعَةَ، عَنْ سَلَمَةَ بْنُ سَابُورَ، عَنْ عَطِيَّةَ، عَنِ ابْنِ عَبَّاسٍ، قَوْلُهُ: غَيْرَ بَاغٍ وَلا عَادٍ قَالَ: غَيْرَ بَاغٍ فِي الْمَيْتَةِ وَلا عَادٍ فِي أَكْلِهِ.
١٥٢٨ - حَدَّثَنَا أَبُو سَعِيدٍ الأَشَجُّ، ثنا أَبُو خَالِدٍ، عَنِ الْحَجَّاجِ، عَنِ الْقَاسِمِ، عَنْ مُجَاهِدٍ غَيْرَ باغ ولا عاد قال: العاد: الْمُخِيفُ لِلسَّبِيلِ، وَرُوِيَ عَنْ سَعِيدِ بْنِ جُبَيْرٍ نَحْوُ ذَلِكَ.

١٥٢٩ - حَدَّثَنَا أَبُو زُرْعَةَ، ثنا عَمْرُو بْنُ حَمَّادٍ، ثنا أَسْبَاطٌ، عَنِ السدي أما العاد:
فَيَعْتَدِي فِي أَكْلهِ، فَيَأْكُلُ حَتَّى يَشْبَعَ، وَلَكِنْ يأكل قوتا مَا يُمْسِكُ بِهِ نَفْسَهُ حَتَّى يَبْلُغَ حَاجَتَهُ.
