It was reported from Salamah ibn al-Akwa’, ‘Alqamah, ‘Ubaydah al-Salmani, al-Sha’bi, ‘Ata’ al-Khurasani, Zayd ibn Aslam, and al-Zuhri, something similar to that.
[The Third Aspect]
Those who interpreted that the verse was revealed concerning the pregnant and nursing woman, then it was abrogated.
1638 - My father narrated to us, Abu Sulaym ‘Abd al-Rahman ibn al-Dahhak narrated to us, al-Walid narrated to us, Khulayd ibn Da’laj narrated to me, from al-Hasan and Qatadah, that the saying of Allah: ‘And upon those who are able to fast [but with hardship]’—he said: It is hindered for them by pregnancy or nursing or something similar to that—similar to the saying of Mujahid and Muhammad ibn Ka’b, they said: Then Allah abrogated that with the other verse, His saying: ‘So whoever among you witnesses the month,’ to His saying: ‘then an equal number of other days.’
[The Fourth Aspect]
Those who interpreted that the verse is decisive (muhkam):
1639 - Hajjaj ibn Hamzah narrated to us, Shababah narrated to us, Warqa’ narrated to us, from Ibn Abi Najih, from Mujahid regarding ‘And upon those who are able to fast [but with hardship], a ransom [as a substitute] of feeding a poor person’: It is not abrogated. This is not permitted except for the old person who is not able, or a sick person who is known not to recover.
1640 - My father narrated to us, ‘Ubayd Allah ibn Musa narrated to us, ‘Uthman ibn al-Aswad reported, he said: I asked Mujahid about my wife, who was pregnant, and her ninth month coincided with the month of Ramadan in intense heat, and she complained to me about the fasting, as it was difficult for her. He said: “Command her to break her fast and feed a poor person every day, then when she recovers, she shall make it up.”
Abu Muhammad said: Mujahid’s opinion agreed on removing the obligation of making it up (qada’) from the old person and obligating him to pay the ransom (fidyah), and he obligated the pregnant woman to pay both the ransom and the make-up. This is likewise the position of al-Hasan and Ibrahim al-Nakha’i in one of his views. This is the position of al-Shafi’i and Ahmad ibn Hanbal.
His saying: ‘A ransom [as a substitute] of feeding a poor person’:
1641 - Harun ibn Ishaq al-Hamdani narrated to us, al-Muharibi narrated to us, from Muslim, from Mujahid, from Ibn ‘Abbas, regarding this verse: ‘And upon those who are able to fast [but with hardship], a ransom [as a substitute] of feeding a poor person’—he said: The very old person who cannot bear the fasting gives in charity half a sa’ for every day.
It was reported from Mujahid, al-Hasan, Sa’id ibn Jubayr, Ibrahim al-Nakha’i, Muqatil ibn Hayyan, and al-Hasan ibn Salih that he gives in charity half a sa’. It was reported from Abu Hurayrah, and one of the two opinions from Ibn ‘Abbas and Makhul.
وَرُوِيَ عَنْ سَلَمَةَ بْنِ الأَكْوَعِ وَعَلْقَمَةَ وَعَبِيدَةَ السَّلْمَانِيِّ وَالشَّعْبِيِّ وَعَطَاءٍ الْخُرَاسَانِيِّ وَزَيْدِ بْنِ أَسْلَمَ والزهري، نحو ذلك

١٦٣٨ - حَدَّثَنَا أَبِي، ثنا أَبُو سُلَيْمٍ عَبْدُ الرَّحْمَنِ بْنُ الضَّحَّاكِ، ثنا الْوَلِيدُ ثني خُلَيْدُ بْنُ دَعْلَجٍ عَنِ الْحَسَنِ وَقَتَادَةَ، أن قول الله: وعلى الذين يطيقونه فَيَمْنَعُهُمْ مِنْهُ حَمْلٌ أَوْ رَضَاعٌ أَوْ نَحْوُ ذَلِكَ- مِثْلَ قول مُجَاهِدٍ وَمُحَمَّدِ بْنِ كَعْبٍ قَالا، ثُمَّ نَسَخَ اللَّهُ ذَلِكَ بِالآيَةِ الأُخْرَى، قَوْلُهُ: فَمَنْ شَهِدَ مِنْكُمُ الشَّهْرَ إِلَى قَوْلِهِ: فَعِدَّةٌ مِنْ أَيَّامٍ أخر

١٦٣٩ - حَدَّثَنَا حَجَّاجُ بْنُ حَمْزَةَ، ثنا شَبَابَةُ، ثنا وَرْقَاءُ، عَنِ ابْنِ أَبِي نَجِيحٍ، عَنْ مُجَاهِدٍ وَعَلَى الَّذِينَ يُطِيقُونَهُ فِدْيَةٌ طَعَامُ مِسْكِينٍ وَاحِدٍ لَيْسَتْ بِمَنْسُوخَةٍ، لَا يُرَخَّصُ هَذَا إِلا لِلْكَبِيرِ الَّذِي لَا يُطِيقُ، أَوْ مَرِيضٍ يُعْلَمُ أَنَّهُ لَا يُشْفَى.
١٦٤٠ - حَدَّثَنَا أَبِي، ثنا عُبَيْدُ اللَّهِ بْنُ مُوسَى، أَنْبَأَ عُثْمَانُ بْنُ الأَسْوَدِ، قَالَ: سَأَلْتُ مُجَاهِدًا عَنِ امْرَأَتِي وَكَانَتْ حَامِلا، فَوَافَقَ تَاسِعُهَا، شَهْرَ رَمَضَانَ فِي حَرٍّ شَدِيدٍ، فَشَكَتْ إِلَيَّ الصَّوْمَ، قَدْ شَقَّ عَلَيْهَا. قَالَ: مُرْهَا فَلْتُفْطِرْ وَتُطْعِمْ مِسْكِينًا كُلَّ يَوْمٍ، فَإِذَا صَحَّتْ فَتَقْضِ.
قَالَ أَبُو مُحَمَّدٍ: وَاتَّفَقَ قَوْلُ مُجَاهِدٍ، عَلَى إِزَالَةِ الْقَضَاءِ عَنِ الشَّيْخِ وَإِلْزَامِهِ الْفِدْيَةَ.
وَأَوْجَبَ عَلَى الْحَامِلِ الْفِدْيَةَ وَالْقَضَاءَ. وَكَذَلِكَ قَوْلُ الْحَسَنِ، وَإِبْرَاهِيمَ النَّخْعِيِّ فِي أَحَدِ أَقْوَالِهِ. وَهُوَ: قَوْلُ الشَّافِعِيِّ وَأَحْمَدَ بْنِ حَنْبَلٍ.
قَوْلُهُ: فِدْيَةٌ طَعَامُ مِسْكِينٍ

وَرُوِيَ عَنْ مُجَاهِدٍ وَالْحَسَنِ وَسَعِيدِ بْنِ جُبَيْرٍ وَإِبْرَاهِيمَ النَّخْعِيِّ وَمُقَاتِلِ بْنِ حَيَّانَ وَحَسَنِ بْنِ صَالِحٍ، أَنَّهُ يَتَصَدَّقُ بِنِصْفِ صَاعٍ وَرُوِيَ عَنِ أَبِي هُرَيْرَةَ وَأَحَدُ الْقَوْلَيْنِ عَنِ ابْنِ عباس ومكحول
