مجلد 11 · صفحة 177

الترجمة · EN

2960: He writes: 2: Tafsir Ibn Kathir: (1/335).

557: 2966: The truth: 1: Ibn Kathir said regarding His saying: "And let him dictate": Meaning, let the debtor dictate to the scribe the debt that is upon his liability, and let him fear Allah regarding that.

559: 2973: Mentally deficient: 1: Al-Qurtubi said regarding His saying: "But if the person who owes the debt is mentally deficient": The transaction of a mentally deficient person under legal interdiction without the permission of his guardian is void by consensus; it is abrogated forever, causes no ruling, and has no effect. If a mentally deficient person who is not under interdiction acts, there is a difference of opinion that will come later.

560: 2983: He writes: 1: Addition from al-Durar: (1/120).

2984: And Allah: 2: Tafsir al-Thawri: (p/ 73).

561: 2989: The witnesses: 1: Ibn Kathir said regarding His saying: "From among those whom you approve as witnesses": It indicates the condition of uprightness (adalah) for witnesses, and this is a constraint that Al-Shafi'i applied to every absolute command in the Qur'an regarding the calling of witnesses without condition. Those who rejected the 'mastur' (one whose character is unknown) used this verse as evidence that a witness must be upright and acceptable.

562: 2992: (...): 1: A blank space in the original.

2997: He testifies: 2: I say: It is in the two Sahihs: "Shall I not inform you of the worst of witnesses? Those who testify before they are asked to testify."

Ibn Kathir: (1/336).

564: 3007: Allah: 1: See, Tafsir al-Qurtubi: (1/1209).

For testimony: 2: See: The previous source. It is established in Sahih Muslim and the Sunan via the chain of Malik from 'Abd Allah ibn Abi Bakr ibn Muhammad ibn 'Amr ibn Hazm, from his father 'Abd Allah ibn 'Amr ibn 'Uthman, from 'Abd al-Rahman ibn Abi 'Amrah.
