Al-Marwazi said: I incline toward the opinion of Malik and Ahmad.

He said: As for the "oath of inadvertence" (laghw), which the generality of scholars have agreed upon as being an idle oath, it is a person's saying: "No, by Allah," or "Yes, by Allah," in his discourse and speech without intending to bind the oath or desiring it. Al-Shafi'i said: This is during contention, anger, and haste.

1191: 6713: Do not break [them]: 1: Mujahid said in the interpretation of His saying: "you have contracted" (aqadtum): meaning you have deliberately intended and purposed. It was narrated from Ibn Umar: That the stress (tashdid) requires repetition, so expiation is not due upon him unless he repeats it. This is refuted by what was narrated that the Prophet (may Allah bless him and grant him peace) said: "I, by Allah—if Allah wills—do not swear an oath and then see that something else is better than it, except that I perform that which is better and offer expiation for my oath." Thus, he mentioned the obligation of expiation for an oath that has not been repeated. Sahih (authentic).
