1206: 6802: Food: 1: Al-Qurtubi said: Regarding ostrich eggs, the penalty is one-tenth of the price of a camel according to Malik. Regarding the eggs of a Makkan pigeon, according to him, it is one-tenth of the price of a sheep. Ibn al-Qasim said:

It is the same whether there is a chick in it or not, provided the chick does not chirp after the shell is broken. If it does chirp, he is liable for the full penalty, as the penalty for a large bird of that type.

Ibn al-Mawwaz said: It is determined by the judgment of two just men. Most scholars hold that for the eggs of every bird, the value is to be paid.

It was narrated from Abu Hurayrah—may Allah be pleased with him—that he said:

The Messenger of Allah (peace and blessings of Allah be upon him) said: "For every ostrich egg, there is either the fasting of one day or the feeding of one poor person."

Narrated by al-Daraqutni (2/248, 249), al-Bayhaqi (5/208), al-Manthur (2/329), al-Qurtubi (6/311), and al-'Ilal (794).

1208: 6814: Fasting: 1: Al-Farra' said: 'Adl (with a kasrah on the 'ayn) is something equivalent from the same species, and 'adl (with a fathah on the 'ayn) is something equivalent from a different species. This view is attributed to al-Kisa'i. You say: I have the 'idl of your dirhams in dirhams, and I have the 'adl of your dirhams in clothes. The correct view regarding al-Kisa'i is that they are two dialects for both the fathah and the kasrah on the 'ayn, and they both mean "the equal." This is the view of the Basrians. Some scholars are of the opinion that one should not exceed two months in the fasting for a penalty; they said: Because that is the maximum for expiations.
