His saying: "And the mothers"

2261 - Hajjaj b. Hamzah narrated to us, Shababah narrated to us, Warqa' narrated to us, from Ibn Abi Najih, from Mujahid, regarding His saying: "And the mothers who are divorced." It has been narrated from al-Zuhri and al-Rabi' b. Anas something similar.

[His saying: "nursing their children"]

2262 - Abu Zur'ah narrated to us, Yahya b. 'Abd Allah b. Bukayr narrated to us, Ibn Lahi'ah narrated to me, 'Ata' b. Dinar narrated to me, from Sa'id b. Jubayr, regarding the statement of Allah: "And the mothers shall nurse their children," this refers to a man who divorces his wife while he has a child with her; she is more entitled to her child than anyone else, so they are the ones who nurse their children.

2263 - 'Isam b. Rawwad al-'Asqalani narrated to us, Adam narrated to us, al-Layth b. Sa'd narrated to us, from 'Uqayl, from Ibn Shihab al-Zuhri, regarding His saying: "And the mothers shall nurse their children for two whole years," meaning: the divorced mothers are more entitled to the nursing of their children, provided they accept what others are given as payment. It has been narrated from al-Suddi something similar.

His saying, the Most High: "For two whole years"

2264 - My father informed us, Abu Bakr Muhammad b. Bashshar narrated to us, Abu 'Adi narrated to us, from Sa'id, from Qatadah, from Abu Harb—meaning the son of Abi al-Aswad al-Du'ali—from his father, that a woman who gave birth after six months was brought before 'Umar b. al-Khattab, and he intended to stone her. This reached 'Ali, who said: There is no stoning for her; Allah the Most High says: "And the mothers shall nurse their children for two whole years," and [He says in another verse about the pregnancy period and weaning], "and his carrying and his weaning is thirty months." So that is thirty months.

2265 - Ahmad b. Sinan narrated to us, Abu Mu'awiyah narrated to us, al-A'mash narrated to us, from Muslim—meaning Abu al-Duha—, a leader of the people of Ibn 'Abbas narrated to me, saying: 'Uthman was brought a woman who had given birth in six months, and he ordered that she be stoned. Ibn 'Abbas said: Bring me near to him. When they brought him near to him, he said: If she were to dispute with you using the Book of Allah, she would defeat you. Allah the Most High says: "And the mothers shall nurse their children for two whole years," and Allah says in another verse: "And his carrying and his weaning is thirty months." So if she carried him for six months, she is to nurse him for you for two whole years. He said: So 'Uthman called for her and let her go.

٢٢٦١ - حَدَّثَنَا حَجَّاجُ بْنُ حَمْزَةَ، ثنا شَبَابَةُ، ثنا وَرْقَاءُ، عَنِ ابْنِ أَبِي نَجِيحٍ عَنْ مُجَاهِدٍ «١»

قَوْلُهُ: وَالْوَالِدَاتُ الْمُطَلَّقَاتُ. وَرُوِيَ عَنِ الزُّهْرِيِّ وَالرَّبِيعِ بْنِ أَنَسٍ، نَحْوُ ذَلِكَ.

[قوله: يرضعن أولادهن]

٢٢٦٢ - حدثنا أبو زرعة، ثنا نحيى بْنُ عَبْدِ اللَّهِ بْنِ بُكَيْرٍ، حَدَّثَنِي ابْنُ لَهِيعَةَ حَدَّثَنِي عَطَاءُ بْنُ دِينَارٍ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ، فِي قَوْلِ اللَّهِ: وَالْوَالِدَاتُ يُرْضِعْنَ أَوْلادَهُنَّ وَهُوَ الرَّجُلُ يُطَلِّقُ امْرَأَتَهُ وَلَهُ مِنْهَا وَلَدٌ، فَهِيَ أَحَقُّ بِوَلَدِهَا مِنْ غَيْرِهَا، فَهُنَّ يُرْضِعْنَ أَوْلادَهُنَّ.

٢٢٦٣ - حَدَّثَنَا عِصَامُ بْنُ رَوَّادٍ الْعَسْقَلانِيُّ، ثنا آدَمُ، ثنا اللَّيْثُ بْنُ سَعْدٍ عَنْ عَقِيلٍ عَنِ ابْنِ شِهَابٍ الزُّهْرِيِّ، فِي قَوْلِهِ: وَالْوَالِدَاتُ يُرْضِعْنَ أَوْلادَهُنَّ حَوْلَيْنِ كَامِلَيْنِ يَعْنِي: الْوَالِدَاتُ الْمُطَلَّقَاتُ أَحَقُّ بِرَضَاعِ أَوْلادِهِنَّ، إِذَا قَبِلْنَ مَا يُعْطَى غَيْرُهُنَّ مِنَ الأَجْرِ. وَرُوِيَ عَنِ السُّدِّيِّ، نَحْوُ ذَلِكَ.

قَوْلُهُ تَعَالَى: حَوْلَيْنِ كَامِلَيْنِ

٢٢٦٤ - أَخْبَرَنَا أَبِي، ثنا أَبُو بَكْرٍ مُحَمَّدُ بْنُ بَشَّارٍ ابنا أَبُي عَدِيٍّ عَنْ سَعِيدٍ، عَنْ قَتَادَةَ عَنْ أَبِي حَرْبٍ، يَعْنِي: ابْنَ أَبِي الأَسْوَدِ الدِّيَلِيِّ، عَنْ أَبِيهِ، أَنَّ عُمَرَ بْنَ الْخَطَّابِ، رُفِعَتْ إِلَيْهِ امْرَأَةٌ وَلَدَتْ لِسِتَّةِ أَشْهُرٍ، فَهَمَّ بِرَجْمِهَا، فَبَلَغَ ذَلِكَ عَلِيًا فَقَالَ: لَيْسَ عَلَيْهَا رَجَمٌ، قَالَ اللَّهُ تَعَالَى: وَالْوَالِدَاتُ يُرْضِعْنَ أَوْلادَهُنَّ حَوْلَيْنِ كَامِلَيْنِ وَسِتَّةَ أَشْهُرٍ، فَذَلِكَ ثَلاثُونَ شَهْرًا.

٢٢٦٥ - حَدَّثَنَا أَحْمَدُ بْنُ سِنَانٍ، ثنا أَبُو مُعَاوِيَةَ، ثنا الأَعْمَشُ، عَنْ مُسْلِمٍ يَعْنِي:

أَبَا الضُّحَى، حَدَّثَنِي قَائِدُ ابْنُ عَبَّاسٍ، قَالَ: أُتِيَ عُثْمَانُ بِامْرَأَةٍ وَلَدَتْ فِي سِتَّةِ أَشْهُرٍ، فَأَمَرَ بِرَجْمِهَا. فَقَالَ ابْنُ عَبَّاسٍ: أَدْنُونِي مِنْهُ فَلَمَّا أَدْنَوْهُ مِنْهُ، قَالَ: إِنَّهَا إِنْ تُخَاصِمْكَ بِكِتَابِ اللَّهِ، تَخْصَمْكَ، يَقُولُ اللَّهُ تَعَالَى وَالْوَالِدَاتُ يُرْضِعْنَ أَوْلادَهُنَّ حَوْلَيْنِ كَامِلَيْنِ وَيَقُولُ اللَّهُ فِي آيَةٍ أُخْرَى وَحَمْلُهُ وَفِصَالُهُ ثَلاثُونَ شَهْرًا فَقَدْ حَمَلَتْهُ سِتَّةَ أَشْهُرٍ، فَهِيَ تُرْضِعُهُ لَكُمْ حَوْلَيْنِ كَامِلَيْنِ، قَالَ: فَدَعَا بِهَا عُثْمَانُ فَخَلَّى سبيلها.
