For the rabbit, there is a ewe [as compensation]; for the jerboa, there is a baraq—which is a lamb; for any dove or similar bird, there are two sheep; and for any locust or similar insect, there is a handful of food.
His saying: "[as] two just men among you have adjudged"
[6803] Muhammad ibn Yahya narrated to us, I found in the book of my grandfather Yahya ibn Durays, in his original copy, that Sufyan narrated from Ibn Jurayj from ‘Ata regarding His saying: "[as] two just men among you have adjudged," he said: He judges it in [cases of] error, intentionality, and forgetfulness.
[6804] ‘Amr al-Awdi narrated to us, Waki‘ narrated to us from al-Mas‘udi from ‘Abd al-Malik ibn ‘Umayr from Qabisah ibn Jabir al-Asadi, he said: We set out as pilgrims. When we prayed the dawn prayer, we would set up our mounts and walk while conversing. While we were walking one morning, an antelope crossed before us or appeared. Waki‘ said: The sanuh is that which crosses [the path], and the barih is that which is in front of you. He said: A man who was with us, who was in the state of ihram, shot it with a stone and did not miss its flank, and it fell dead on its side. He said: We became angry with him. When I arrived in Mecca, I went out with him until we came to ‘Umar. He told him the story. He said: Beside him was a man sitting whose face was like a silver disk—meaning ‘Abd al-Rahman ibn ‘Awf—so he turned to his companion and spoke to him, then he turned to our companion and said: Did you kill it intentionally or by error? The man said: I intended to shoot it, but I did not intend to kill it. ‘Umar said: How do you know? You have combined intentionality and error. Go to a sheep and slaughter it, and give its meat in charity, and [saddle/prepare] its skin—meaning give it to a poor person so he may use it as a water skin. He said: So we rose from his presence. I said to my companion: O man, magnify the rites of Allah. By Allah, the Commander of the Faithful did not hold back the judgment for you until he consulted his companion. Qabisah said: Go to your she-camel and slaughter it, so he did that. Qabisah said: And the verse in Surah al-Ma’idah, "[as] two just men among you have adjudged," was mentioned. He said: My statement reached ‘Umar, and he suddenly appeared to us carrying his whip. He said: He struck my companion with it, saying: You kill in the Sacred Precinct and make light of the judgment? Then he turned to me to strike me, so I said: O Commander of the Faithful, it is not lawful for you [to do so], it is forbidden to you. He said: O Qabisah ibn Jabir, I see you are young in age, broad-minded, and eloquent of tongue. In a young person, there may be nine good traits and one bad trait, and the bad trait spoils the good ones. Beware of the slips of youth.
[6805] Abu Ibrahim al-Fadl ibn Dukayn narrated to us, Ja‘far ibn Burqan narrated to us from Maymun ibn Mihran that a Bedouin came to Abu Bakr and said: I killed game while I was in the state of ihram, so what do you see [is] the compensation upon me?
وَالأَرْنَبُ فِيهِ بينةٌ مِنَ الْغَنَمِ وَالْيَرْبُوعُ فِيهِ بَرَقٌ وَهُوَ الْحَمَلُ، وَمَا كَانَ مِنْ حَمَامَةٍ أَوْ نَحْوِهَا مِنَ الطَّيْرِ فِيهِمَا شَاةٌ وَمَا كَانَ مِنْ جَرَادَةٍ أَوْ نَحْوِهَا فَفِيهِمَا قَبْضَةٌ مِنْ طَعَامٍ.
قَوْلُهُ تَعَالَى: يَحْكُمُ بِهِ ذَوَا عَدْلٍ مِنْكُمْ
٦٨٠٣ - حَدَّثَنَا مُحَمَّدُ بْنُ يَحْيَى وَجَدْتُ فِي كِتَابِ جَدِّي يَحْيَى بْنِ ضُرَيْسٍ فِي أَصْلِهِ الْعَتِيقِ، ثنا سُفْيَانُ عَنِ ابْنِ جُرَيْجٍ عَنْ عَطَاءٍ قَوْلَهُ: يَحْكُمُ بِهِ ذَوَا عَدْلٍ قَالَ: يَحْكُمُ عَلَيْهِ فِي الْخَطَأِ وَالْعَمْدِ وَالنِّسْيَانِ.
٦٨٠٤ - حَدَّثَنَا عَمْرٌو الأَوْدِيُّ، ثنا وَكِيعٌ عَنِ الْمَسْعُودِيِّ عَنْ عَبْدِ الْمَلِكِ بْنِ عُمَيْرٍ عَنْ قَبِيصَةَ بْنِ جَابِرٍ الأَسَدِيِّ قَالَ: خَرَجْنَا حُجَّاجًا فَكُنَّا إِذَا صَلَّيْنَا الْفَجْرَ أَقَمْنَا رَوَاحِلَنَا نَتَمَاشَا نَتَحَدَّثُ فَبَيْنَمَا نَحْنُ ذَاتَ غَدَاةٍ نَمْشِي إِذْ نسح لَنَا ظَبْيٌ أَوْ بَرَحَ قَالَ وَكِيعٌ: السُّنُوحُ الَّذِي يَعْتَرِضُ، وَالْبَارِحُ، أَمَامَكَ. قَالَ: فَرَمَاهُ رَجُلٌ كَانَ مَعَنَا وَهُوَ مُحْرِمٌ بِحَجَرٍ فَمَا أَخْطَأَ حَشَاهُ فَرَكِبَ رِدْعَهُ مَيْتًا. قَالَ: فَغَضِبْنَا عَلَيْهِ، فَلَمَّا قَدِمْتُ مَكَّةَ خَرَجْتُ مَعَهُ حَتَّى أَتَيْنَا عُمَرَ. فَقَصَّ عَلَيْهِ الْقِصَّةَ. قَالَ: وَإِذَا إِلَى جَنْبِهِ رَجُلٌ جَالِسٌ كَأَنَّ وَجْهَهُ قَلْبُ فِضَّةٍ، يَعْنِي عَبْدَ الرَّحْمَنِ بْنَ عَوْفٍ- فَالْتَفَتَ إِلَى صَاحِبِهِ فَكَلَّمَهُ ثُمَّ أَقْبَلَ عَلَى صَاحِبِنَا فَقَالَ:
أَعَمْدًا قَتَلْتَهُ أَمْ خَطَأً قَالَ: الرَّجُلُ: لَقَدْ تَعَمَّدْتُ رَمْيَهُ وَمَا أَرَدْتُ قَتْلَهُ. قَالَ: عُمَرُ:
ما أدراك إِلا قَدْ أَشْرَكْتَ بَيْنَ الْعَمْدِ وَالْخَطَأِ، اعْمَدْ إِلَى شَاةٍ فَاذْبَحْهَا وَتَصَدَّقْ بِلَحْمِهَا أَسْقِ إِهَابَهَا يَعْنِي ادْفَعْهُ إِلَى مِسْكِينٍ يَجْعَلَهُ سِقَاءً قَالَ: فَقُمْنَا مِنْ عِنْدِهِ. فَقُلْتُ لِصَاحِبِي: أَيُّهَا الرَّجُلُ أَعْظِمْ شَعَائِرَ اللَّهِ وَاللَّهِ مَا دَرَأَ أَمِيرُ الْمُؤْمِنِينَ مَا يُفْتِيكَ حَتَّى شَاوَرَ صَاحِبَهَ. قَالَ قَبِيصَةُ: اعْمَدْ إِلَى نَاقَتِكَ فَانْحَرْهَا فَفَعَلَ ذَلِكَ. قَالَ قَبِيصَةُ وَمَا أُذْكِرَ الآيَةَ فِي سُورَةِ الْمَائِدَةِ يَحْكُمُ بِهِ ذَوَا عَدْلٍ مِنْكُمْ قَالَ: فَبَلَغَ عُمَرَ مَقَالَتِي فَلَمْ يَفْجَأْنَا بِهِ إِلا وَمَعَهُ الدِّرَّةُ قَالَ: فَعَلا صَاحِبِي ضَرْبًا بِهَا وَهُوَ يَقُولُ: أَقَتَلْتَ فِي الْحَرَمِ وَسَفَّهْتَ الْحُكْمَ ثُمَّ أَقْبَلَ عَلَيَّ لِيَضْرِبَنِي فَقُلْتُ: يَا أمير المؤمنين لا أحل لك حُرِّمَ عَلَيْكَ قَالَ: يَا قَبِيصَةُ بْنَ جَابِرٍ إِنِّي أَرَاكَ شَابَّ السِّنِّ فَسِيحَ الصَّدْرِ بَيِّنَ اللِّسَانِ، وَأَنَّ الشَّابَّ يَكُونُ فِيهِ تِسْعَةُ أَخْلاقٍ حَسَنَةٌ وَخُلُقٌ سَيِّئٌ فَيُفْسِدُ الْخُلُقُ السَّيِّئُ الأَخْلاقَ الْحَسَنَةَ وَإِيَّاكَ وَعَثَرَاتِ الشَّبَابِ.
٦٨٠٥ - حَدَّثَنَا أَبُو إِبْرَاهِيمَ الْفَضْلُ بْنُ دُكَيْنٍ، ثنا جَعْفَرِ بْنِ بُرْقَانَ عَنْ مَيْمُونِ بْنِ مِهْرَانَ أَنَّ أَعْرَابِيًّا أَتَى أَبَا بَكْرٍ قَالَ: قَتَلْتُ صَيْدًا وَأَنَا مُحْرِمٌ فَمَا تَرَى عَلَيَّ مِنَ الْجَزَاءِ.
