and he, along with Abu Bakr, came to visit me, and they were walking. They arrived while I had fainted, so the Messenger of Allah (peace and blessings of Allah be upon him) performed ablution, then poured his ablution water over me, and I regained consciousness. I said: 'O Messenger of Allah, how should I bequeath my wealth? How should I act regarding my wealth?' The Messenger of Allah (peace and blessings of Allah be upon him) did not answer me until the verse of inheritance was revealed.
[6329] Muhammad ibn ‘Abd Allah ibn Yazid al-Muqri’ narrated to us, Sufyan narrated to us, and Abu al-Zubayr said, meaning Jabir: "It was revealed concerning me: 'They ask you for a ruling. Say, Allah gives you a ruling regarding the kalalah.'"
The explanation of the kalalah has already preceded.
His saying, the Almighty: "If a man dies..."
[6330] Ahmad ibn ‘Uthman ibn Hakim al-Awdi narrated to us, Ahmad ibn Mufaddal narrated to us, Asbat narrated to us, from al-Suddi regarding His saying: "If a man dies (in amru’un halaka)," he says: "Has died."
Similar to this was narrated from Sa’id ibn Jubayr.
His saying, the Almighty: "...who has no child but has a sister."
[6331] Abu Zur’ah narrated to us, Yahya narrated to us, Ibn Lahi’ah narrated to us, ‘Ata’ narrated to me, from Sa’id ibn Jubayr regarding the saying of Allah the Almighty: "...who has no child but has a sister," [meaning] from his father and mother, or from his father.
His saying, the Almighty: "...she will have half of what he left."
[6332] And by the same chain, from Sa’id ibn Jubayr regarding the saying of Allah the Almighty: "...she will have half of what he left," [meaning] from the inheritance, and the remainder is for the agnatic heirs (al-‘asabah).
His saying, the Almighty: "And he inherits from her if she has no child."
[6333] And by the same chain, from Sa’id ibn Jubayr regarding the saying of Allah the Almighty: "And he inherits from her if she has no child."
His saying, the Almighty: "But if there are two [sisters]..."
[6334] And by the same chain, from Sa’id ibn Jubayr regarding His saying: "But if there are two [sisters]," he said: "If the brother dies and he has two sisters or more, from his father and mother or from his father."
وَسَلَّمَ يَعُودُنِي هُوَ وَأَبُو بَكْرٍ وَهُمَا مَاشِيَانِ وَجَاءَا وَقَدْ أُغْمِيَ عَلَيَّ، فَتَوَضَّأَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ثُمَّ صَبَّ عَلَيَّ وُضُوءِهِ، فَأَفَقْتُ. فَقُلْتُ: يَا رَسُولَ اللَّهِ، كَيْفَ أُوصِي فِي مَالِي؟ كَيْفَ أَصْنَعُ فِي مَالِي؟ فَلَمْ يُجِبْنِي رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ حَتَّى نَزَلَتْ آيَةُ الْمِيرَاثِ.
٦٣٢٩ - حَدَّثَنَا مُحَمَّدُ بْنُ عَبْدِ اللَّهِ بْنِ يَزِيدَ الْمُقْرِئُ، ثنا سُفْيَانُ وَقَالَ أَبُو الزُّبَيْرِ قَالَ:
يَعْنِي جَابِرًا أُنْزِلَتْ فِيَّ يَسْتَفْتُونَكَ قُلِ اللَّهُ يُفْتِيكُمْ فِي الْكَلالَةِ
وَقَدْ تَقَدَّمَ تَفْسِيرُ الْكَلالَةِ.
قَوْلُهُ تَعَالَى: إِنِ امرؤ هَلَكَ.
٦٣٣٠ - حَدَّثَنَا أَحْمَدُ بْنُ عُثْمَانَ بْنِ حَكِيمٍ الأَوْدِيُّ، ثنا أَحْمَدُ بْنُ مُفَضَّلٍ، ثنا أَسْبَاطٌ عَنِ السُّدِّيِّ قوله: إن امرؤ هَلَكَ يَقُولُ: مَاتَ.
وَرُوِيَ عَنْ سَعِيدِ بْنِ جُبَيْرٍ مِثْلُ ذَلِكَ.
قَوْلُهُ تَعَالَى: لَيْسَ لَهُ وَلَدٌ وَلَهُ أُخْتٌ.
٦٣٣١ - حَدَّثَنَا أَبُو زُرْعَةَ، ثنا يَحْيَى، ثنا ابْنُ لَهِيعَةَ، حَدَّثَنِي عَطَاءٌ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ فِي قَوْلِ اللَّهِ تَعَالَى: لَيْسَ لَهُ وَلَدٌ وَلَهُ أُخْتٌ مِنْ أَبِيهِ وَأُمِّهِ، أَوْ مِنْ أَبِيهِ.
قَوْلُهُ تَعَالَى: فَلَهَا نِصْفُ مَا تَرَكَ.
٦٣٣٢ - وَبِهِ عَنْ سَعِيدِ بْنِ جُبَيْرٍ فِي قَوْلِ اللَّهِ تَعَالَى: فَلَهَا نِصْفُ مَا تَرَكَ مِنَ الْمِيرَاثِ وَالْبَقِيَّةُ لِلْعَصَبَةِ.
قَوْلُهُ تَعَالَى: وَهُوَ يَرِثُهَا إِنْ لَمْ يَكُنْ لَهَا وَلَدٌ.
٦٣٣٣ - وَبِهِ عَنْ سَعِيدِ بْنِ جُبَيْرٍ فِي قَوْلِ اللَّهِ تَعَالَى: وَهُوَ يَرِثُهَا إِنْ لَمْ يَكُنْ لَهَا وَلَدٌ.
قَوْلُهُ تَعَالَى: فَإِنْ كَانَتَا اثْنَتَيْنِ.
٦٣٣٤ - وَبِهِ عَنْ سَعِيدِ بْنِ جُبَيْرٍ قَوْلَهُ: فَإِنْ كَانَتَا اثْنَتَيْنِ قَالَ: فَلَوْ مَاتَ الأَخُ وَكَانَتْ لَهُ أُخْتَانِ فَصَاعِدًا مِنْ أَبِيهِ وَأُمِّهِ أَوْ مِنْ أَبِيهِ.
