His saying: "There is no blame upon you."
14361 - Through the same chain of narration, from Sa'id ibn Jubayr, regarding His saying: "There is no blame upon you," [he said]: It means: there is no restriction upon you.
His saying, the Exalted: "to enter houses not inhabited."

14362 - Abu Sa'id al-Ashajj narrated to us, [saying]: Abu Nu'aym al-Ahwal narrated to us, [saying]: Khalid ibn Iyas narrated to us, [saying]: My grandmother Umm Iyas narrated to me, [and] she said: I was among four women seeking permission to enter upon 'A'ishah, so I said: "May we enter?" She said: "No." I then said to your companion: "May we seek permission?" She said: "Peace be upon you, may we enter?" She replied: "Enter." Then she said: "O you who have believed, do not enter houses other than your own houses..." up to His saying: "houses not inhabited." He [the narrator] said: They are the houses of merchants in which there is no permission.
14363 - Abu Sa'id al-Ashajj narrated to us, [saying]: 'Abd Allah ibn Qabisah al-Fazari narrated to us, from Hajjaj, from Salim, from Ibn al-Hanafiyyah, regarding "houses not inhabited," [he said]: They are your houses that are in the marketplace.

14364 - Abu Sa'id al-Ashajj narrated to us, [saying]: Abu Khalid narrated to us, from Juwaybir, from al-Dahhak, regarding His saying: "in which there is a convenience for you," [he said]: The houses that the wayfarer descends into for shelter from the heat and the cold, for protection from the rain, and for the security of your belongings.
14365 - Abu Zur'ah narrated to us, [saying]: Yahya ibn 'Abd Allah narrated to us, [saying]: Ibn Lahi'ah narrated to me, [saying]: 'Ata' ibn Dinar narrated to me, from Sa'id ibn Jubayr, regarding the saying of Allah: "There is no blame upon you for entering houses not inhabited," [he said]: It means: in which there are no residents, and these are the inns located on the paths of people for the traveler, in which there is no resident. He said: There is no blame upon you to enter them without permission and without salutation therein, meaning: in the houses that are on the paths of people. Similar to this was reported from Mujahid in one of the narrations, as well as from al-Dahhak and al-Suddi.
14366 - Hajjaj ibn Hamzah narrated to us, [saying]: Shababah narrated to us, [saying]: Warqa' narrated to us, from Ibn Abi Najih, from Mujahid, regarding "houses not inhabited," [he said]: They used to place saddles and goods on the road to Medina in houses where there was no one, so it was made lawful for them to enter them without permission.
قوله: لَيْسَ عَلَيْكُمْ جُنَاحٌ.
١٤٣٦١ - بِهِ عَنْ سَعِيدِ بْنِ جُبَيْرٍ قَوْلُهُ: لَيْسَ عَلَيْكُمْ جُنَاحٌ يَعْنِى لَا حَرَجَ عَلَيْكُمْ.
قَوْلُهُ تَعَالَى: أَنْ تَدْخُلُوا بيوتا غير مسكونة.

١٤٣٦٢ - حَدَّثَنَا أَبُو سَعِيدٍ الأَشَجُّ، ثنا أَبُو نُعَيْمٍ الأَحْوَلُ، ثنا خَالِدُ بْنُ إِيَاسٍ، حَدَّثَتْنِي جَدَّتِي أُمُّ إِيَاسٍ، قَالَتْ: كُنْتُ فِي أَرْبَعِ نِسْوَةٍ نَسْتَأْذِنُ عَلَى عَائِشَةَ فَقُلْتُ نَدْخُلُ؟
فَقَالَتْ: لَا، فَقُلْتُ لِصَاحِبَتِكُنَّ نَسْتَأْذِنُ؟ فَقَالَتِ: السَّلامُ عَلَيكُمْ أَنَدْخُلُ؟ فَقَالَتْ:
ادْخُلُوا، ثُمَّ قَالَتْ: يَا أَيُّهَا الَّذِينُ آمَنُوا لا تَدْخُلُوا بُيُوتًا غَيْرَ بُيُوتِكُمْ إِلَى قَوْلِهِ:
بُيُوتًا غَيْرَ مَسْكُونَةٍ قَالَ: هِيَ بُيُوتُ التُّجَّارِ لَا إِذْنَ فِيهَا.
١٤٣٦٣ - حَدَّثَنَا أَبُو سَعِيدٍ الأَشَجُّ، ثنا عَبْدُ اللَّهِ بْنُ قَبِيصَةَ الْفَزَارِيُّ، عَنْ حَجَّاجٍ، عَنْ سَالِمٍ، عَنِ ابْنِ الْحَنَفِيَّةِ بُيُوتًا غَيْرَ مَسْكُونَةٍ قَالَ: هِيَ بُيُوتُكُمُ الَّتِي فِي السُّوقِ.
وَالْوَجْهُ الثَّانِي:
١٤٣٦٤ - حَدَّثَنَا أَبُو سَعِيدٍ الأَشَجُّ، ثنا أَبُو خَالِدٍ، عَنْ جُوَيْبِرٍ، عَنِ الضَّحَّاكِ فِي قَوْلِهِ: بُيُوتًا غَيْرَ مَسْكُونَةٍ فِيهَا مَتَاعٌ لَكُمْ قَالَ: الْبُيُوتُ الَّتِي يَنْزِلُهَا ابْنُ السَّبِيلِ مَأْوًى مِنَ الْحَرِّ وَالْبَرَدِ وَكِنٌّ مِنَ الْمَطَرِ وَحِرْزٌ لأنفسكم.
١٤٣٦٥ - حَدَّثَنَا أَبُو زُرْعَةَ، ثنا يحى بْنُ عَبْدِ اللَّهِ، حَدَّثَنِي ابْنُ لَهِيعَةَ حَدَّثَنِي عَطَاءُ ابْنُ دِينَارٍ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ فِي قَوْلِ اللَّهِ: لَيْسَ عَلَيْكُمْ جُنَاحٌ أَنْ تَدْخُلُوا بُيُوتًا غَيْرَ مَسْكُونَةٍ يَعْنِى: لَيْسَ بِهَا مَسَاكِنُ، وَهِيَ الْخَانَاتُ الَّتِي عَلَى طُرُقِ النَّاسِ، لِلْمُسَافِرِ لَيْسَ فِيهَا سَاكِنٌ، قَالَ: لَا جُنَاحَ عَلَيْكُمْ أَنْ تَدْخُلُوهَا بِغَيْرِ اسْتِئْذَانٍ وَلا تَسْلِيمٍ فِيهَا يَعْنِى: فِي الْبُيُوتِ الَّتِي فِي طُرُقِ النَّاسِ، وَرُوِِىِ عَنْ مُجَاهِدٍ فِي إِحْدَى الرِّوَايَاتِ، وَالضَّحَّاكِ، وَالسُّدِّيِّ نَحْوُ ذَلِكَ.
١٤٣٦٦ - حَدَّثَنَا حَجَّاجُ بْنُ حَمْزَةَ، ثنا شَبَابَةُ، ثنا وَرْقَاءُ عَنِ ابْنِ أَبِي نَجِيحٍ عَنْ مُجَاهِدٍ بُيُوتًا غَيْرَ مَسْكُونَةٍ كَانُوا يَضَعُونَ بِطَرِيقِ الْمَدِينَةِ أَقْتَابًا وَأَمْتِعَاتٍ فِي بُيُوتٍ لَيْسَ فِيهَا أَحَدٌ، فَأُحِلَّتْ لَهُمْ أَنْ يَدْخُلُوهَا بِغَيْرِ إِذْنٍ.
