it occurs, just as if he had spoken without conditions; and once it occurs, there is no way to rescind it.

Section: Muhanna narrated regarding a man whose wife said to him: "Place my affair in my own hands, and I will give you this slave of mine." He took possession of the slave, placed her affair in her hands, and sold the slave before the woman said anything. It is his; she only said: "Place my affair in my own hands and I will give you [this slave]." It was said to him (6): When she wills, can she choose? He said: "Yes, as long as he does not have intercourse with her or rescind it." He thus granted him the right to retract as long as she has not pronounced the divorce. If he retracts, it is appropriate for her to reclaim the compensation from him; because he has taken back what he gave to her, so she reclaims from him what she gave him. If he said: "When the beginning of the month arrives, your affair is in your hands," he possesses the right to cancel this condition; because it is permissible to retract this even if it were not suspended, so it is even more appropriate when suspended, like an agency. Ahmad said: If his wife gave him a thousand dirhams on the condition that he grant her the choice, and she chose the husband, he does not return anything to her. The reason for this is that the thousand [dirhams] were in exchange for his conferring the choice upon her, and he has indeed done so, so he is entitled to the thousand, and the thousand is not in exchange for the separation.

Section: If his wife says: "Divorce me for a dinar," and he divorces her, then she apostatizes, the dinar becomes binding upon her, and the divorce occurs as irrevocable (ba'in). The apostasy has no effect, because it occurred after (7) the irrevocability. If he divorces her after her apostasy and before he has consummated the marriage with her, she becomes irrevocable by the apostasy (8), and the divorce does not occur; because it encountered her [already] irrevocable. If this is after consummation, and we hold that apostasy causes the marriage to be annulled immediately, then the same applies. If we hold that it is suspended until the expiration of the waiting period, then the divorce is considered pending. If she persists in her apostasy until her waiting period expires, it becomes clear that she was not his wife (9) when he divorced her, so it did not occur, and he has no claim against her. If she returns to Islam, it becomes clear that the divorce encountered his wife (10), so it occurred, and he is entitled to the compensation from her.

فوقَعَ، كما لو أطْلَقَ، ومتى وقعَ، فلا سَبِيلَ إلى رَفْعِه.

فصل: نقلَ مُهَنَّا، فى رجلٍ قالت له امرأتُه: اجْعَلْ أَمْرِى بيَدِى، وأُعْطِيك عَبْدِى هذا. فقَبَضَ العبدَ، وجعلَ أمرَها بيدِها، وباع العبدَ قبلَ أن تقولَ المرأةُ شيئًا: هو له، إنَّما قالتْ: اجعَلْ أمْرِى بيَدِى وأُعْطِيك. فقيل له (٦): متى شاءتْ تخْتارُ؟ قال: نعم، ما لم يَطأْها، أو ينقُضْ. فجعلَ له الرُّجوعَ ما لم تُطَلِّقْ. وإذارجَعَ فيَنْبَغِى أن تَرْجِعَ عليه بالعِوَضِ؛ لأنَّه اسْتَرْجَعَ ما جعَلَ لها، فتَسْترجِعُ منه ما أعْطَتْه. ولو قال: إذا جاء رأسُ الشَّهرِ فأمْرُك بيدكِ. ملَكَ إبطالَ هذه الصِّفةِ؛ لأنَّ هذا يجوزُ الرُّجُوعُ فيه لو لم يكُنْ مُعَلَّقًا، فمعَ التَّعْليقِ أوْلَى، كالوكالةِ. قال أحمدُ: ولو جعَلتْ له امرأتُه ألفَ درهمٍ على أن يُخيِّرَها، فاخْتارتِ الزَّوجَ، لا يَرُدُّ عليها شيئًا، ووَجْهُه أَنَّ الألْفَ فى مُقابلَةِ تمْليكِه إيَّاها الخيارَ، وقد فعلَ، فاسْتَحقَّ الألفَ، وليستِ الألفُ فى مُقابلَةِ الفُرْقةِ.

فصل: إذا قالتِ امْرأتُه: طلِّقْنِى بدينارٍ. فطلَّقَها، ثم ارْتدَّتْ، لزمَها الدِّينارُ، ووقعَ الطَّلاقُ بائنًا، ولا تُؤثِّرُ الرِّدَّةُ؛ لأنَّها وُجِدَتْ بعدَ (٧) البَيْنُونةِ. وإن طلَّقَها بعد رِدتِها وقبلَ دخولِه يها، بانَتْ بالرِّدَّةِ (٨)، ولم يقَعِ الطَّلاقُ؛ لأنَّه صادفَها بائنًا، فإن كان بعدَ الدُّخولِ، وقُلْنا: إن الرِّدَّةَ ينْفَسِخُ بها النِّكاحُ فى الحالِ. فكذلك، وإن قُلْنا: يَقِفُ على انْقِضاءِ العِدَّةِ. كان الطَّلاقُ مُرَاعًى. فإن أقامتْ على رِدَّتِها حتى انْقَضتْ عِدَّتُها، تَبيَّنَّا أنَّها لم تكُنْ زَوْجتَه (٩) حين طلَّقَها، فلم يقَعْ، ولا شىءَ له علها، وإن رجَعتْ إلى الإِسلامِ، بانَ أَنَّ الطَّلاقَ صادَفَ زَوْجتَه (١٠)، فوقعَ، واستَحَقَّ عليها العِوَضَ.
