The occurrence of the divorce for each one of them is a divorcing, because it is by a condition he originated for them after he had suspended their divorce upon her divorce. Thus, a divorce from each one of them returned upon her, completing three for her. ‘Amra was divorced twice: one by the divorcing of Hafsa, and another by the occurrence of the divorce upon Zaynab, because it is a divorcing of Zaynab according to what we mentioned. Zaynab was divorced once, because the divorce of her two co-wives by the condition is not a divorcing in regard to her. If he said to each one of them: "Whenever one of your two co-wives is divorced, you are divorced," then he divorced the first, she is divorced three times, the second is divorced twice, and the third is divorced once. This is because his divorcing of the first is a condition for the divorce of her two co-wives, and the occurrence of the divorce upon both of them is a divorcing in relation to her, as it occurs by a condition he originated after suspending her divorce upon their divorce. Thus, a divorce from the divorcing of each one of them returned upon her, completing three for her. A second divorce returned upon the second from the divorce of the third for that reason, but nothing returned upon the third from their divorce that occurred by the condition, because it is not a divorcing in regard to her. If he divorced the second, she is also divorced twice, the first is divorced three times, and the third is divorced once. If he divorced the third, the first is divorced twice, and each one of the remaining two is divorced once.

لما تَقَدَّمَ. وإن طلَّقَ حفصةَ، طَلُقَتْ ثلاثًا؛ لأنَّها طَلُقَت واحدةً بالمُبَاشِرةِ، فطَلُقَتْ بها ضَرَّتاها (٦٧)، ووقوعُ الطَّلاقِ بكِل واحدةٍ منهما تَطْليق؛ لأنَّه بصفةٍ أحْدَثَها فيها بعدَ تعليقِ طلاقِها بطلاقِهما، فعادَ عليها من طَلاقِ كل واحدةٍ منهما طلقةٌ، فكَمُلَ لها ثلاثٌ، وطَلُقَتْ عَمْرَةُ طَلْقتَيْنِ، واحدةً بتَطْليقِ حفصةَ، وأُخْرَى بوُقوعِ الطَّلاقِ على زينبَ؛ لأنَّه تَطْليقٌ لزينبَ؛ لما ذكرناه، وطَلُقَتْ (٦٨) زينبُ واحدةً؛ لأنَّ طلاقَ ضَرَّتَيْها بالصِّفةِ، ليس بتَطْليقٍ فى حقِّها. وإن قال لكلِّ واحدةٍ منهنَّ: كلَّما طَلُقَتْ إحْدَى ضَرَّتيْكِ، فأنت طالقٌ. ثم طلَّقَ الأُولَى، طَلُقَت ثلاثًا، وطَلُقَتْ الثَّانيةُ. طَلْقتَيْنِ، والثَّالثةُ طَلْقةً (٦٩) واحدةً؛ لأنَّ [تَطْليقَه للأُولَى] (٧٠) شَرْط لطلاقِ ضَرَّتَيْها، ووقوعَ الطَّلاقِ بهمَا تطليق بالنِّسبةِ إليها، لكَوْنه واقعًا بصِفَةٍ أحْدثَها بعدَ تَعْليقِ طَلاقِها بطلاقِهما، فعادَ عليها من تَطْليقِ كلِّ واحدةٍ منهما طَلْقة، فكَمُلَ لها الثَّلاثُ، وعاد على الثَّانيةِ من طلاقِ الثَّالثةِ طلقةٌ ثانيةٌ لذلك، ولم يَعُدْ على الثَّالثةِ (٧١) من طلاقِهما الواقعِ بالصِّفةِ شىءٌ؛ لأنَّه ليس (٧٢) بتطْليقٍ فى حقِّها. وإن طلَّقَ الثانيةَ طَلُقَتْ أيضًا [طَلْقَتَيْنِ، وطَلُقَتِ] (٧٣) الأُولَى ثلاثًا، والثَّالثةُ طلقةً. وإن طلَّقَ الثَّالثةَ، طَلُقَتِ الأُولى طَلْقتَيْنِ، وطَلُقَتْ كلُّ واحدةٍ من الباقيتَيْنِ طَلْقةً طلقةً.

فصل: ولو قال لامرأتِه: إن طَلَّقْتُك فعَبْدِى حُرٌّ. ثم قال لعبدِه: إن قُمتَ فامرأتى طالقٌ. فقام، طَلُقَتِ المرأةُ، وعَتَقَ العبدُ. ولو قال لعبدِه: إن قُمتَ فامرأتى طالقٌ. ثم قال لامرأتِه: إن طلَّقتُك فعَبْدِى حُرٌّ. فقامَ العبدُ، طَلُقَتِ المرأةُ، ولم يَعْتِقِ العبدُ؛ لأنَّ
