from one color to another, or waiting for food to be brought to him, it is not counted except as one meal; the same applies here. The first view is more appropriate (18) because a small amount of sa'ut (nasal administration) and wajur (oral administration) is considered a suckling, so this is likewise (19).
1368 - Issue: He said: (The sa'ut is like breastfeeding, and likewise is the wajur.)
The meaning of sa'ut is that milk is poured into his nose from a vessel or otherwise. The wajur is that it is poured into his throat (1) without the breast. There is a difference of opinion regarding the prohibition established by these two. The more correct of the two narrations is that prohibition is established by them, just as it is established by breastfeeding. This is the view of al-Sha'bi, al-Thawri, and the People of Opinion (Ashab al-Ra'y). Malik also held this view regarding the wajur. The second [narration] is that prohibition is not established by them. This is the preference of Abu Bakr, the school of Dawud, and the statement of 'Ata' al-Khurasani regarding the sa'ut, because this is not breastfeeding, and Allah the Almighty and His Messenger only prohibited by way of breastfeeding. Also, because it occurred without suckling, it is similar to if it entered through a wound in his body. Our argument is what was reported by Ibn Mas'ud from the Prophet (peace and blessings of Allah be upon him): "There is no breastfeeding except that which strengthens the bone and causes the flesh to grow." Reported by Abu Dawud (2). Furthermore, because the milk reaches through this [method] to the same place it reaches via suckling, [and it results in the same growth of flesh and strengthening of bone that results from suckling] (3), it must equal it in prohibition. The nose is a path [for the breaking of a fasting person's fast] (4), so it is a path for prohibition, just like breastfeeding by the mouth.
Section: This only prohibits what is prohibited by breastfeeding, which is five [times] in the well-known narration, for it is a branch of breastfeeding and thus takes its ruling. If he suckled and completed the five [times] with sa'ut

من لَوْنٍ إلى لَوْنٍ، أو انْتظارٍ لما يُحْمَلُ إليه من الطَّعامِ، لم يُعَدَّ إلَّا أكْلةً واحدةً، فكذا ههُنا. والأَوّلُ أوْلَى (١٨)؛ لأنَّ اليَسِيرَ من السَّعُوطِ والوَجُورِ رَضْعةٌ، فكذا هذا (١٩).
١٣٦٨ - مسألة؛ قال: (وَالسَّعُوطُ كَالرَّضَاعِ، وكَذلِكَ الْوَجُورُ)
معنى السَّعُوطِ: أن يُصَبَّ اللَّبَنُ في أنْفِه من إنَاءٍ أو غيرِه. والوَجُورُ: أن يُصَبَّ في حَلْقِه صَبًّا من (١) غيرِ الثَّدْىِ. واخْتلَفتِ الرِّوايةُ في التَّحْريمِ بهما، فأصَحُّ الرّوايتَيْنِ أنَّ التَّحْريمَ يَثْبُتُ بذلك، كما يثبتُ بالرَّضاعِ. وهو قولُ الشَّعْبيِّ، والثَّوْرِيِّ، وأصْحابِ الرَّأْيِ. وبه قال مالكٌ في الوَجُورِ. والثانية، لا يَثْبُتُ بهما التحريمُ. وهو اختيارُ أبي بكرٍ، ومذهبُ داودَ، وقولُ عَطاءٍ الخُرَاسانيِّ في السَّعُوطِ؛ لأنَّ هذا ليس برَضاعٍ، وإنَّما حَرَّمَ اللَّه تعالى ورسولُه بالرَّضاعِ، ولأنَّه حَصَلَ من غير ارْتِضاعٍ، فأشْبَهَ ما لو دَخَلَ من جُرْحٍ في بَدَنِه. ولَنا، ما رَوَى ابنُ مسعودٍ، عن النَّبِيِّ -صلى اللَّه عليه وسلم-: "لَا رَضَاعَ إلَّا مَا أَنْشَزَ الْعَظْمَ، وأَنْبَتَ اللَّحْمَ". روَاه أبو داودَ (٢). ولأنَّ هذا يَصِلُ به اللَّبَنُ إلى حيث يَصِلُ بالارْتِضاعِ، [ويَحْصُلُ به من إنْباتِ اللَّحْمِ وإنْشازِ العَظْمِ ما يَحْصُلُ من الارْتِضاعِ] (٣)، فيَجِبُ أن يُسَاوِيَه في التَّحْرِيمِ، والأنْفُ سَبِيلٌ [لفِطْرِ الصائِمِ] (٤). فكان سَبيلًا للتَّحْرِيمِ، كالرَّضاعِ بالفَمِ.
فصل: وإنَّما يُحَرِّمُ من ذلك مثلُ الذي يُحَرِّمُ بالرَّضاعِ، وهو خَمْسٌ في الرِّوايةِ المشهورة، فإنَّه فَرْعٌ على الرَّضاعِ، فيَأْخُذُ حُكْمَه، فإن ارْتَضَعَ وكمَّلَ الخَمْسَ بسَعُوطٍ
