Except for the prescribed punishment (hadd) for alcohol consumption. As for the punishment for alcohol, some said it is carried out using hands, sandals, and the ends of garments. Some of our companions mentioned that the Imam has the discretion to do that if he sees fit, based on what Abu Hurayrah narrated, that the Messenger of Allah (peace and blessings of Allah be upon him) was brought a man who had drunk, and he said: "Strike him." He said: "So among us was he who struck with his hand, he who struck with his sandal, and he who struck with his garment." Narrated by Abu Dawud. Our argument is that the Prophet (peace and blessings of Allah be upon him) said: "If he drinks wine, then lash him." Lashing, by its unqualified usage, is understood to mean striking with a whip. Furthermore, because he ordered his lashing just as Allah the Almighty ordered the lashing of the fornicator, it is thus with a whip, just as the latter. The Rightly Guided Caliphs struck with whips, as did others, so this constitutes consensus (ijma'). As for the hadith of Abu Hurayrah, it was at the beginning of the matter, then the Prophet (peace and blessings of Allah be upon him) lashed [offenders], and matters were established. It is authentically reported that the Prophet (peace and blessings of Allah be upon him) lashed forty, Abu Bakr lashed forty, Umar lashed eighty, and Ali lashed al-Walid ibn Uqbah forty. In the account of the lashing of Qudamah when he drank, it is stated that Umar said: "Bring me a whip." His servant Aslam brought him a thin, small whip, and Umar took it, wiped it with his hand, then said to Aslam: "I will tell you, you mentioned his kinship to your people; bring me a whip other than this." He brought him a complete one, and Umar ordered that Qudamah be lashed. Once this is established, the whip should be of medium quality, neither new so that it cuts, nor worn out so that its pain is lessened;

غيرِ حدِّ الخمرِ. فأمَّا حَدُّ الخمرِ، فقال بعضُهم: يُقامُ بالأيْدِى والنِّعالِ وأطْرافِ الثِّيابِ. وذكرَ بعضُ أصحابِنا، أنَّ للإِمامِ فعلَ ذلك إِذا رآه؛ لما رَوَى أبو هُرَيْرةَ، أنَّ رسولَ اللَّه -صلى اللَّه عليه وسلم- أُتِىَ بِرَجُلٍ قد شَرِبَ، فقال: "اضْرِبُوه". قال: فمِنَّا الضَّارِبُ بيَدِه، والضاربُ بنَعْلِه (٨)، والضاربُ بثَوْبِه. روَاه أبو داودَ (٩). ولَنا، أنَّ النَّبِىَّ -صلى اللَّه عليه وسلم- قال: "إذا شَرِبَ الْخَمْرَ، فَاجْلِدُوهُ" (١٠). والجلدُ إنَّما يُفْهَمُ من إطْلاقِه الضربُ بالسَّوْطِ، ولأنَّه أَمَرَ بجَلْدِه، كما أَمَرَ اللهُ تعالى بجَلْدِ الزَّانِى، فكان بالسَّوْطِ مِثْلَه، والخلفاءُ الرَّاشِدون ضَرَبُوا بالسِّيَاطِ (١١)، وكذلك غيرُهم، فكانَ إجماعًا. فأمَّا حديثُ أبى هُرَيْرَةَ، فكان في بَدْءِ الأمرِ، ثم جَلَدَ النَّبِىُّ -صلى اللَّه عليه وسلم-، واسْتقرَّتِ الأمورُ، فقد صَحَّ أنَّ النَّبِىَّ -صلى اللَّه عليه وسلم- جَلَدَ أربعين، وجَلَدَ أبو بكرٍ أربعين، وجَلَدَ عمرُ ثمانين، وجَلَدَ عَلِىٌّ الوليدَ (١٢) بنَ عُقْبةَ أربعين (١٣). وفي حديثِ جَلْدِ قُدامةَ، حينَ شَرِبَ، أنَّ عمرَ قال: ائْتُونِى بسَوْطٍ. فجاءَه أسْلَمُ مَوْلاه بسَوْطٍ دَقِيقٍ صغيرٍ، فأخذَه عمرُ، فمسَحَه بَيدِه، ثم قال لأسْلَمَ: أنا أحدِّثُك، إنَّك ذكرتَ قَرابتَه لأهلِكَ، ائْتِنِى بِسَوْطٍ غيرِ هذا. فأتاه به تامًّا، فأمرَ عمرُ بقُدامةَ فجُلِدَ (١٤). إذا ثبتَ هذا، فإنَّ السَّوْطَ يكون وَسَطًا، لا جديدٌ (١٥) فيَجْرَحُ،
