by leaving the eating, so it does not undermine its training, unlike the dog and the leopard. As for the report, it is not sound; it is narrated by Mujalid, and he is weak. Ahmad said: Mujalid makes the story into one, and how many marvels are there from Mujalid. The sound reports contradict him, and analogy of birds to predatory beasts is not valid due to the difference between them. If this is established, then every bird of prey that can be trained and hunted with, such as the falcon, the hawk, the peregrine, and the eagle, its hunting is lawful based on what we have mentioned.
1704 - Issue: He said: (And what is hunted by the black dog, when it is solid black, is not eaten; because it is a devil.)
Al-bahim is that whose color is not mixed with any other color. Ahmad said: That which has no white in it. Tha'lab and Ibrahim al-Harbi said: Every color that is not mixed with another color is bahim. It was said to them: Of every color? They said: Yes. Among those who disliked its hunting are al-Hasan, al-Nakha'i, Qatadah, and Ishaq. Ahmad said: I do not know anyone who permits it, meaning among the predecessors. Abu Hanifah, Malik, and al-Shafi'i permitted its hunting due to the generality of the verse and the report, and the analogy to other dogs. Our evidence is that it is a dog whose keeping is forbidden and its killing is mandatory, so its hunting is not permitted, like an untrained one. The evidence for the prohibition of keeping it is the saying of the Prophet - may Allah bless him and grant him peace -: "Kill every solid black one among them." Narrated by Sa'ir and others. And Muslim narrated in his "Sahih" with his chain from Abdullah ibn al-Mughaffal, who said: The Messenger of Allah - may Allah bless him and grant him peace - ordered us to kill

بِتَركِ الأَكْلِ، فلم يَقْدَحْ فى تَعْليمِها، بخلافِ الكلبِ والفهْدِ. وأمَّا الخبرُ، فلا يَصِحُّ، يَرْوِيه مُجالِدٌ، وهو ضعيف. قال أحمد: مُجالِدٌ يُصَيِّرُ القِصَّةَ واحدةً، كم من أُعْجوبَةٍ لمُجالِدٍ. والرِّواياتُ الصَّحِيحةُ تُخالِفُه، ولا يصِحُّ قياسُ الطَّيْرِ على السِّباعِ؛ لما بَيْنَهُما من الفَرْقِ. إذا ثَبَتَ هذا، فكُلُّ جارِحٍ من الطَّيرِ أَمْكَنَ تَعْلِيمُه، والاصطيادُ به، من الْبازِىِّ والصَّقْرِ والشَّاهِين والعُقابِ، حَلَّ صَيْدُهَا على ما ذكرْناه.
١٧٠٤ - مسألة؛ قال: (ولَا يُؤْكَلُ مَا صِيدَ بِالْكَلْبِ الْأَسْوَدِ، إذَا كَانَ بَهِيمًا؛ لأنَّهُ شَيْطَانٌ)
البَهِيمُ: الذى لا يُخالطُ لونَه لونٌ سِواهُ (١). قال أحمدُ: الذى ليس فيه بَياضٌ. قال ثعلبٌ، وإبراهيمُ الْحَرْبِىُّ: كُلُّ لَوْنٍ لم يُخالِطْه لَوْنٌ (٢) آخرُ فهو (٣) بهيمٌ. قيلَ لهما: من كُلِّ لَوْنٍ؟ قالا: نَعَمْ. وممَّن كرِهَ صَيْدَه الحَسَنُ، والنَّخَعِىُّ، وقَتادَةُ، وإسحاقُ. قال أحمد: ما أعْرِفُ أحدًا يُرَخِّصُ فيه. يَعْنِى من السَّلَفِ. وأباحَ صَيْدَه أبو حنيفةَ، ومالِكٌ، والشافِعِىُّ؛ لعُمومِ الآيَةِ والخَبَرِ، والقياسِ على غيرِه من الكلابِ. ولَنا، أنَّه كَلْبٌ يحْرُمُ اقْتِناؤُه، ويجبُ قَتْلُه، فلم يُبَحْ صَيْدُه، كغيرِ المُعَلَّمِ، ودليلُ تَحْريِم اقْتِنائِه قولُ النَّبِىِّ -صلى اللَّه عليه وسلم-: "فاقْتُلُوا مِنْها كُلَّ أسْوَدَ بَهِيمٍ". روَاه سعير، وغيرُه (٤). ورَوَى مسلمٌ، فى "صَحِيحِه" (٥)، بإسْنادِه عن عبدِ اللَّه بن المُغَفَّلِ، قال: أَمرَنا رسولُ اللَّه -صلى اللَّه عليه وسلم- بقَتْلِ
