to al-Abbas. Their wala' is today for them. And that Urwa purchased the wala' of Tahman for the heirs of Mus'ab ibn al-Zubayr. Ibn Jurayj said: I said to 'Ata': If I give my client (mawla) permission to affiliate with whomever he wishes, is that permissible? He said: Yes. Our argument is that the Prophet, peace and blessings of Allah be upon him, forbade the sale of wala' and its gifting. He said: "Wala' is a bond like the bond of lineage." He also said: "May the curse of Allah be upon those who pledge loyalty (tawalla) to others than their own mawali." Furthermore, it is a quality through which one inherits, so it is not transferable, just like kinship. The actions of these individuals are anomalous, contradict the position of the majority, and are refuted by the Sunnah; thus, they are not to be relied upon.
Section: The wala' does not transfer from the emancipator upon his death, nor do his heirs inherit it. Rather, they inherit wealth through it while it remains with the emancipator. This is the position of the majority. Something similar has been narrated from Umar, Ali, Zayd, Ibn Mas'ud, Ubayy ibn Ka'b, Ibn Umar, Abu Mas'ud al-Badri, and Usama ibn Zayd. This is also the position of 'Ata', Tawus, Salim ibn Abd Allah, al-Hasan, Ibn Sirin, al-Sha'bi, al-Zuhri, al-Nakha'i, Qatada, Abu al-Zinad, Ibn Qusayt, Malik, al-Thawri, al-Shafi'i, Ishaq, Abu Thawr, the People of Opinion (Ashab al-Ra'y), and Dawud. Shurayh dissented and said: Wala' is like property; it is inherited from the emancipator, so whoever owns something during his life, it goes to his heirs. This was narrated by Hanbal and Muhammad ibn al-Hakam from Ahmad. Abu Bakr judged them to be mistaken, and it is as he said; for the report of the group from Ahmad is like the position of the group, and that is due to his saying, peace be upon him: "Wala' is for the one who emancipates." And his saying: "Wala' is a bond like the bond of lineage." Lineage is not inherited, but rather one inherits through it, and because it is a quality through which one inherits, it is not transferable, like all other legal causes, and Allah, the Exalted, knows best.

للعباسِ. وولاؤُهم اليومَ لهم. وأنَّ عُرْوةَ ابْتاعَ ولاءَ طَهْمانَ لِوَرَثةِ مُصْعَبِ بن الزُّبَيرِ. وقال ابنُ جُرَيْجٍ: قلتُ لعطاءٍ: أَذِنْتُ لِمَولاىَ أن يُوَالِىَ مَن شاءَ فيَجُوزُ؟ قال: نَعَمْ. ولَنا، أَنَّ النَّبِىَّ -صلى اللَّه عليه وسلم- نَهَى عن بَيْع الوَلاءِ وعن هِبَتِه (٢٥). وقال: "الوَلاءُ لُحْمةٌ كلُحْمَةِ النَّسَبِ" (٢٦). وقال: "لَعَنَ اللَّهُ مَنْ تَوَلَّى غَيْرَ مَوَالِيه" (٢٥). ولأنَّه مَعْنًى يُورَثُ به فلا يَنْتَقِلُ كالقَرابةِ. وفِعْلُ هؤلاءِ شاذٌّ يخالِفُ قولَ الجُمهورِ، وتَرُدُّه السُّنَّةُ، فلا يُعَوَّلُ عليه.
فصل: ولا يَنْتَقِلُ الوَلاءُ عن المُعْتِقِ بمَوْتِه، ولا يَرِثُه ورَثَتُه، وإنَّما يَرِثُونَ المالَ به مع بَقائِه للمُعْتِقِ. هذا قولُ الجمهورِ. ورُوِىَ نحوُ ذلك عن عمرَ، وعلىٍّ، وزَيْدٍ، وابنِ مسعودٍ، وأَبَىِ بن كَعْبٍ، وابنِ عمرَ، وأبى مسعودٍ البَدْرِىِّ، وأُسامةَ بنِ زيدٍ. وبه قال عطاءٌ، وطاوُسُ، وسالمُ بن عبدِ اللَّه، والحسنُ، وابنُ سِيرِينَ، والشَّعْبِىُّ، والزُّهْرِىُّ، والنَّخَعِىُّ، وقَتادَةُ، وأبو الزِّنادِ، وابنُ قُسَيْطٍ (٢٧)، ومالكٌ والثَّورِىُّ، والشافعىُّ، وإسحاقُ، وأبو ثَوْرٍ، وأصْحابُ الرَّأْىِ، وداودُ. وشَذَّ شُرَيْحٌ، وقال: الوَلاءُ كالمالِ، يُورَثُ عن المُعْتِقِ، فمن مَلَكَ شيئًا حياتَه فهو لِوَرَثَتِه. وروَاه حَنْبلٌ، ومحمدُ بن الحَكَمِ، عن أحمدَ. وغَلَّطَهُما أبو بكرٍ، وهو كما قال؛ فإنَّ رِوايةَ الجماعةِ عن أحمدَ مثلُ قولِ الجماعةِ، وذلك لقولِه عليه السلامِ: "الوَلَاءُ لِلْمُعْتِقِ" (٢٨). وقوله: "الوَلَاءُ لُحْمَةٌ كلُحْمَةِ النَّسَبِ". والنَّسَبُ لا يُورَثُ، وإنَّما يُورَثُ به، ولأنَّه معنى يُورَثُ به، فلا يَنْتَقِلُ، كسائرِ الأسْبابِ (٢٩)، واللَّهُ تعالى أعلمُ.
