For rulings, so it is necessary that we affirm their rulings, just as if each existed individually. If he gave him [the share] due to his orphanhood and then his poverty ceased, he is not given anything for his poverty.
1083 - Issue: He said: (And four-fifths of the Fay' are for all Muslims; their rich and their poor are equal in it, except for slaves).
We do not know of any disagreement among the people of knowledge today that slaves have no right to the Fay'. The apparent meaning of the words of Ahmad and al-Khiraqi is that the rest of the people have a right to the Fay', both the rich and the poor among them. Ahmad mentioned the Fay' and said: In it is a right for all Muslims, and it is shared between the rich and the poor. Umar, may Allah be pleased with him, said: There is no one among the Muslims who does not have a portion in this wealth, except for slaves, for they have nothing in it. Umar recited: {Whatever Allah has returned to His Messenger from the people of the towns} until he reached: {And those who came after them} (1). Then he said: This has encompassed the Muslims generally. If I live, the shepherd at the height of Himyar will surely receive his portion of it, without his forehead sweating for it (2) (3). And because it is wealth subject to a fifth (al-khums), it is not restricted to those who have benefit in it, just like the four-fifths of the spoils of war. The Qadi mentioned that the people of the Fay' are the people of Jihad from those stationed in the frontier regions, the army of the Muslims, and those who attend to their interests; because that was for the Prophet, peace and blessings of Allah be upon him, during his lifetime, for the attainment of support and interest through it. When he died, it became for the army (4) and those whom the Muslims need, so it became for them to the exclusion of others. As for the Bedouins and their like, who do not prepare themselves for Jihad, they have no right to it. Those who go on campaigns when they are active are given from the share of 'the path of Allah' from the Sadaqah. He said: The meaning of Ahmad's words is that it is shared between the rich and the poor, meaning the richness that contains the interests of the Muslims, such as the Mujahidin, the judges, and the jurists. It is possible that the meaning of his words is that all Muslims have the benefit of that wealth because it is spent on those whose benefit returns to (6) all

لأحْكامٍ، فوَجَبَ أن نُثَبِّتَ أحْكَامَها، كما لو انْفَرَدَتْ. فإن أعطاه لِيُتْمِه، فزال فَقْرُه، لم يُعْطَ لِفَقْرِه شيئا.
١٠٨٣ - مسألة؛ قال: (وأَرْبَعَةُ أَخْمَاسِ الْفَىْءِ لِجمِيعِ الْمُسْلِمِينَ؛ غَنِيُّهُمْ وفَقيِرُهُمْ فِيهِ سَوَاءٌ، إلَّا الْعَبِيدَ)
لا نعلمُ خِلافًا بين أهلِ العلمِ اليومَ فى أَنَّ العَبِيدَ لا حَقَّ لهمِ فى الفَىْءِ. وظاهرُ كلامِ أحمدَ، والخِرَقِىِّ، أَنَّ سائرَ الناس لهم حَقٌّ فى الفَىْءِ، غَنِيَّهم وفَقِيرَهم. ذَكَرَ أحمدُ الفَىْءَ فقال: فيه حقٌّ لكلِّ المسلمينَ، وهو بين الغَنِىِّ والفقيرِ. وقال عمرُ، رَضِىَ اللَّهُ عنه: ما مِن أحَدٍ من المسلمينَ إلَّا له فى هذا المالِ نصيبٌ، إلَّا العَبِيدَ، فليس لهم فيه شىءٌ. وقرأ عمرُ: {مَا أَفَاءَ اللَّهُ عَلَى رَسُولِهِ مِنْ أَهْلِ الْقُرَى} حتى بَلَغ: {وَالَّذِينَ جَاءُوا مِنْ بَعْدِهِمْ} (١) ثم قال: هذه اسْتَوْعَبَتِ المسلمينَ عامَّةً، ولئن عِشْتُ ليَأْتِيَنَّ الرَّاعِىَ بسَرْوِ حِمْيَرَ نَصِيبُه منها، لم يَعْرَقْ فيه (٢) جَبِينُه (٣). ولأنَّه مالٌ مَخْمُوسٌ، فلم يَخْتَصَّ به مَن فيه مَنْفَعةٌ، كأرْبَعةِ أخماسِ الغَنِيمةِ. وذَكَرَ القاضى أَنَّ أهلَ الفَىْءِ هم أهلُ الجِهَادِ من المُرَابطِينَ فى الثُّغُورِ، وجُنْدِ المُسْلِمينَ، ومَنْ يقومُ بمَصالِحِهم؛ لأنَّ ذلك كان للنَّبِىِّ -صلى اللَّه عليه وسلم- فى حياتِه، لحُصُولِ النُّصْرةِ والمَصْلحةِ به، فلما مات صارتْ بالجُنْدِ (٤)، ومَنْ يحتاجُ إليه المسلمونَ، فصار ذلك لهم دون غيرِهم، وأمَّا الأَعْرابُ ونحوُهم ممَّن لا يُعِدُّ نَفْسَه للجِهادِ، فلا حَقَّ لهم فيه. والذين يَغْزُونَ إذا نَشِطُوا، يُعْطَوْنَ من سَهْمِ سبيلِ اللَّهِ من الصَّدَقةِ. قال: ومعنى كلامِ (٥) أحمدَ، أنَّه بين الغَنِىِّ والفقيرِ، يعنى الغِنَى الذى فيه مصلحةُ المسلمينَ من المُجاهدِينَ والقضاةِ والفقهاءِ. ويَحْتَمِلُ أن يكونَ معنى كلامِه، أَنَّ لجميعِ المسلمينَ الانتفاعَ بذلك المالِ؛ لكَوْنِه يُصْرَفُ إلى مَنْ يَعُودُ نَفْعُه إلى (٦) جميعِ
