Among those who held the view of its prohibition are Ali, Ibn Abbas, Ata, Tawus, Mujahid, al-Hasan, al-Sha'bi, al-Qasim, Urwah, Malik, al-Thawri, al-Awza'i, al-Shafi'i, Ishaq, Abu Ubayd, Abu Thawr, and Ibn al-Mundhir, as well as the Scholars of Opinion (Ashab al-Ra'y). Ibn Abd al-Barr said: The jurists of the major cities in the Hijaz, Iraq, and the Levant, as well as a group of the People of Hadith, went along with this. Sa'id ibn al-Musayyib, Abu Salamah ibn Abd al-Rahman, Sulayman ibn Yasar, Ata ibn Yasar (3), al-Nakha'i, and Abu Qilabah granted a dispensation regarding the milk of the stallion. It is also narrated (4) from Ibn al-Zubayr and a group of the Companions of the Messenger of Allah (peace and blessings of Allah be upon him)—who are not named—because nursing is from the woman, not the man. It is narrated from Zaynab bint Abi Salamah that Asma bint Abi Bakr, the wife of al-Zubayr, nursed her. She said: Al-Zubayr would enter upon me while I was combing my hair; he would take hold of a lock of my hair and say: "Turn toward me and speak to me, for I consider you a father, and those you have borne are my siblings." Then, Abdullah ibn al-Zubayr sent to me to propose to my daughter, Umm Kulthum, on behalf of Hamzah ibn al-Zubayr, and Hamzah was [the son of the woman] from the Kalb tribe. I said to his messenger: "Is she lawful for him, when she is only the daughter of his sister (5)?" Abdullah said: "You only intend by this refusal to preserve what is with you. As for what Asma bore, they are your siblings, but those who are not from Asma are not your siblings. So send and ask about this." She sent and asked (6), while the Companions of the Messenger of Allah (peace and blessings of Allah be upon him) were present, and they said to her: "Nursing on the part of the man does not prohibit anything." So she married her to him, and she remained with him until he passed away (7). الفَحْلِ. وممَّن قال بتَحْرِيمه علىُّ، وابنُ عباسٍ، وعَطاءٌ، وطاوُسٌ، ومُجاهدٌ، والحسنُ، والشَّعْبِىُّ، والقاسمُ، وعروةُ، ومالكٌ، والثَّوْرىُّ، والأوْزَاعىُّ، والشافعىُّ، وإسْحاقُ، وأبو عُبَيْدٍ، وأبو ثَوْرٍ، وابنُ المُنْذِرِ، وأصْحابُ الرَّأْىِ. قال ابنُ عبدِ البَرِّ: وإليه ذَهَبَ فقهاءُ الأمصارِ بالحِجازِ والعراقِ والشامِ، وجماعةُ أهْلِ الحديثِ. ورَخَّصَ فى لبنِ الفَحْلِ سَعِيدُ بن المُسَيَّبِ، وأبو سَلَمةَ بن عبدِ الرحمنِ، وسليمانُ بن يَسَارٍ، وعَطاءُ ابن يَسارٍ (٣)، والنَّخَعِىُّ، وأبو قِلَابةَ. ويُرْوَى (٤) ذلك عن ابنِ الزُّبَيْرِ، وجماعةٍ من أصحابِ رسولِ اللَّه -صلى اللَّه عليه وسلم- غيرِ مُسَمّينَ؛ لأنَّ الرَّضاعَ من المرأةِ لا من الرَّجُلِ. ويُرْوَى عن زَيْنبَ بنت أبى سَلَمةَ، أنَّها أرْضَعَتْها أسماءُ بنتُ أبى بكرٍ، امرأةُ الزُّبَيْرِ، قالت: وكان الزبيرُ يَدْخُلُ عَلَىَّ وأنا أمْتَشِطُ، فيأخذُ بقَرْنٍ من قُرُونِ رَأْسِى، فيقول: أقْبِلِى علىَّ فحَدِّثِينِى. أرَاه والدًا، وما وَلَدَ فهم إخْوَتِى، ثم إنَّ عبدَ اللَّه بن الزُّبيرِ أرْسَلَ إلىّ يَخْطُبُ أُمَّ كُلْثُومٍ ابنتِى، على حَمْزةَ بن الزُّبَيْرِ، وكان حَمْزةُ للكَلْبِيَّةِ فقلتُ لرَسُولِه: وهل تَحِلُّ له، وإنّما هى ابنةُ أُخْتِه (٥)؟ فقال عبدُ اللَّه: إنَّما أردْتِ بهذا المَنْعَ لما قِبَلَكِ، أمَّا ما وَلَدَتْ أسماءُ فهم إخْوَتُكِ، وما كان من غيرِ أسْماءَ فليسوا لكِ بإخْوةٍ، فأرْسِلِى فسَلِى عن هذا، فأرْسَلَتْ فسألتْ (٦)، وأصحابُ رسولِ اللَّه -صلى اللَّه عليه وسلم- متوافِرُون، فقالوا لها: إنَّ الرَّضاعةَ من قِبَلِ الرَّجُلِ لا تُحَرِّمُ شيئًا. فأنْكَحَتْها إيَّاهُ، فلم تَزَلْ عندَه حتى هَلَكَ عنها (٧). ولَنا، ما رَوَتْ عائشةُ، رَضِىَ اللَّهُ عنها، أَنَّ أفْلَحَ أخا أبى القُعَيْس، اسْتَأْذَنَ
