disagreement, praise be to Allah, except for what we have previously mentioned. The grandfather is like the father in this regard, and the son's son is like the son; because they are included in the names "fathers" and "sons". It makes no difference in this whether the relative is close or distant, an heir or otherwise, from the paternal or maternal side (3), or from the children of sons or the children of daughters. This has been previously addressed.

1149 - Issue; he said: (And everyone we have mentioned among those prohibited by lineage or nursing, their daughters are all prohibited, except for the daughters of paternal aunts and maternal aunts, and the daughters of those women who have been married by fathers and sons; for they are lawful. Likewise are the daughters of a wife with whom he has not consummated the marriage.)

The summary of this is that for every prohibited woman, her daughter is also prohibited, due to the prohibition encompassing her. Thus, mothers prohibit their daughters because they are sisters, paternal aunts, or maternal aunts. Daughters prohibit their daughters because they are [their own] daughters. Daughters of sisters and their daughters are prohibited because they are the daughters of a sister; and likewise are the daughters of the daughters of a brother. Except for the daughters of paternal aunts and maternal aunts, they are not prohibited by consensus, due to the saying of Allah the Almighty: {And the daughters of your paternal uncle and the daughters of your paternal aunts and the daughters of your maternal uncle and the daughters of your maternal aunts} (1). Allah made them lawful for His Prophet, peace and blessings be upon him, and because they were not mentioned in the prohibition, they fall under the generality of the saying of Allah the Almighty: {And lawful to you are [all others] beyond these} (2). Likewise, the daughters of the wives of fathers and sons are not prohibited; [because they were prohibited due to being the wives of fathers and sons] (4), and this is not found in their daughters, nor is there any other effective cause (illa) found in them that would necessitate their prohibition. Therefore, they fall under His, the Exalted, saying: {And lawful to you are [all others] beyond these}. Likewise, the daughters of...

اختلافٌ بحمدِ اللَّه، إلَّا شىءٌ ذكَرْناه فيما تقدَّم. والجَدُّ كالأبِ فى هذا، وابنُ الابنِ كالابْنِ فيه؛ لأنَّهم يَدْخُلُونَ فى اسْمِ الآباءِ والأبْناءِ، وسواءٌ فى هذا القَرِيبُ والبَعِيدُ، والوارثُ وغيرُه، من قِبَلِ الأبِ أو الأُمِّ (٣)، ومن وَلَدِ البَنِين أو وَلَدِ البَناتِ. وقد تقدَّم ذلك.

١١٤٩ - مسألة؛ قال: (وكُلُّ مَنْ ذَكَرْنَا مِنَ الْمُحَرَّمَاتِ مِنَ النَّسَبِ والرَّضَاعِ، فبَنَاتُهُنَّ فِى التَّحْرِيمِ كلُّهُنَّ، إلَّا بَناتِ الْعَمَّاتِ والْخَالَاتِ، وبَنَاتِ مَنْ نَكَحْنَ الْآباءَ والأبْناءَ، فَإنَّهُنَّ مُحَلَّلَاتٌ، وكَذلِكَ بَنَاتُ الزَّوْجةِ الَّتى لَمْ يَدْخُلْ بهَا)

وجملةُ ذلك أَنَّ كلَّ مُحَرَّمةٍ تَحْرُمُ ابْنَتُها، لتَناوُلِ التَّحْريمِ لها، فالأُمَّهاتُ تَحْرُمُ بَنَاتُهُنَّ؛ لأنَّهنَّ أخواتٌ أو عَمَّاتٌ أو خالاتٌ، والبناتُ تَحْرُمُ بَنَاتُهنَّ؛ لأنَّهنَّ بَنَاتٌ، ويَحْرُمُ بناتُ الأخَواتِ وبَناتُهنَّ؛ لأنَّهنَّ بَناتُ الأخْتِ، وكذلك بَناتُ بناتِ الأَخِ، إلَّا بَناتِ العَمَّاتِ والخالاتِ، فلا يُحَرمْنَ بالإِجْماعِ؛ لقولِ اللَّه تعالى: {وَبَنَاتِ عَمِّكَ وَبَنَاتِ عَمَّاتِكَ وَبَنَاتِ خَالِكَ وَبَنَاتِ خَالَاتِكَ} (١). فأَحَلَّهُنَّ اللَّهُ لنَبِيِّه عليه السلام، ولأنَّهنَّ لم يُذْكَرْنَ فى التَّحْريمِ، فيَدْخُلْنَ فى قولِ اللَّه تعالى: {وَأُحِلَّ لَكُمْ مَا وَرَاءَ ذَلِكُمْ} (٢) وكذلك لا يَحْرُمُ بناتُ (٣) زَوْجاتِ الآباءِ والأبناءِ؛ [لأنَّهُنَّ حُرِّمْنَ لكَوْنِهِنَّ حَلائلَ الآباءِ والأبْناءِ] (٤)، ولم يُوجَدْ ذلك فى بَناتِهِنَّ، ولا وُجِدَتْ فيهنَّ عِلّةٌ أُخْرَى تَقْتَضِى تحرِيمَهنَّ، فدَخَلْنَ فى قوله سبحانه: {وَأُحِلَّ لَكُمْ مَا وَرَاءَ ذَلِكُمْ}. وكذلك بَناتُ
