166 - Zakariyya ibn Yahya Abu Yahya al-Naqid narrated to me, saying: Abu Talib narrated: Abu Abd Allah was asked about thieves who enter upon a man by force. He said: "He should fight them, but he should not intend to kill them." It was said to him: "Should he strike them with a sword?" He replied: "He should repel them from himself with whatever he is able, with a sword or otherwise, and he should not intend to kill them." He was asked: "If he strikes him and kills him, is there anything upon him?" I said: "Does the Sultan not hold him liable for anything in that regard?" He said: "If people know that he killed him in his house, what would be upon him? There is nothing upon him; he is only fighting in defense of his wealth and his person."
