[His saying: The Exalted, "Or he who holds the marriage knot in his hand."]

[The First Aspect]

2359 - It was mentioned from Ibn Lahi'ah, 'Amr b. Shu'ayb narrated to me, from his father, from his grandfather, from the Prophet (peace and blessings of Allah be upon him) who said: "The possessor of the marriage knot is the husband."

2360 - Yunus b. Habib narrated to us, Abu Dawud reported to us, Jarir b. Hazim reported to us, from 'Isa b. 'Asim, he said: I heard Shurayh say: 'Ali b. Abi Talib asked me about the one in whose hand is the marriage knot. I said: It is the woman's guardian (wali). Then 'Ali said: No, rather it is the husband.

In one of the narrations from Ibn 'Abbas, Jubayr b. Mut'im, Sa'id b. al-Musayyib, Shurayh in one of his two opinions, Sa'id b. Jubayr, Mujahid, al-Sha'bi, 'Ikrimah, Nafi', Muhammad b. Sirin, al-Dahhak, Muhammad b. Ka'b al-Qurazi, Jabir b. Zayd, Abu Mijlaz, al-Rabi' b. Anas, Iyas b. Mu'awiyah, Makhul, and Muqatil b. Hayyan, it is that he is the husband.

[The Second Aspect]

2361 - My father narrated to us, Ibn Abi Maryam reported to us, Muhammad b. Muslim reported to us, 'Amr b. Dinar narrated to me, from Ibn 'Abbas, regarding the one whom Allah mentioned, "In whose hand is the marriage knot," he said: That is her father, her brother, or whomever she cannot be married except with his permission.

It is reported from 'Alqamah, al-Hasan, 'Ata', Tawus, al-Zuhri, Rabi'ah, Zayd b. Aslam, Ibrahim al-Nakha'i, 'Ikrimah in one of his two opinions, and Muhammad b. Sirin in one of his two opinions, that it is the guardian (wali).

His saying: "And that you forgo is closer to righteousness."

2362 - Yunus b. 'Abd al-A'la informed us by way of reading, he said: Ibn Wahb said, I heard Ibn Jurayj narrating from 'Ata' b. Abi Rabah, from Ibn 'Abbas, he said: The closer of the two of them to righteousness is the one who forgoes.

It is reported from 'Ata' the like of that.
