His saying, the Exalted: "half of what your wives leave"
4917 - And by the same chain, from Sa'id ibn Jubayr regarding His saying: "and for you is half of what your wives leave": He says: For the man is half of what his wife leaves when she dies.
His saying, the Exalted: "if they have no child"
4918 - And by the same chain, from Sa'id ibn Jubayr regarding His saying: "if they have no child": if she has no child from her husband from whom she died, or from other than him.
His saying, the Exalted: "but if they have a child"
4919 - And by the same chain, from Sa'id ibn Jubayr regarding His saying: "but if they have a child": if she has a child, whether male or female.
His saying, the Exalted: "then for you is the fourth"
4920 - And by the same chain, from Sa'id ibn Jubayr regarding His saying: "then for you is the fourth": meaning, for the husband.
His saying, the Exalted: "of what they leave"
4921 - And by the same chain, from Sa'id regarding His saying: "of what they leave": meaning, of the wealth they left.
His saying, the Exalted: "they may have bequeathed"
4922 - And with the same chain, from Sa'id ibn Jubayr regarding His saying: "after any bequest they may have bequeathed": [it refers to] the women.
His saying, the Exalted: "or debt"
4923 - And by the same chain, from Sa'id ibn Jubayr regarding His saying: "or debt": a debt upon them. He said: So the debt comes before the bequest; therein is a precedence.
His saying, the Exalted: "And for them"
4924 - And by the same chain, from Sa'id ibn Jubayr regarding His saying: "And for them": meaning, the women.
His saying, the Exalted: "the fourth"
4925 - And by the same chain, from Sa'id ibn Jubayr regarding His saying: "And for them is the fourth of what you leave": meaning, for the woman is the fourth.
قَوْلُهُ تَعَالَى: نِصْفُ مَا تَرَكَ أَزْوَاجُكُمْ
٤٩١٧ - وَبِهِ عَنْ سَعِيدِ بْنِ جُبَيْرٍ قَوْلَهُ: وَلَكُمْ نِصْفُ مَا تَرَكَ أَزْوَاجُكُمْ يَقُولُ:
لِلرَّجُلِ نِصْفُ مَا تَرَكَتِ امْرَأَتُهُ إِذَا مَاتَتْ.
قَوْلُهُ تَعَالَى: إِنْ لَمْ يَكُنْ لَهُنَّ وَلَدٌ
٤٩١٨ - وَبِهِ عَنْ سَعِيدِ بْنِ جُبَيْرٍ قَوْلَهُ: إِنْ لَمْ يَكُنْ لَهُنَّ وَلَدٌ: إِنْ لَمْ يَكُنْ لَهَا وَلَدٌ مِنْ زَوْجِهَا الَّذِي مَاتَتْ عَنْهُ أَوْ مِنْ غَيْرِهِ.
قَوْلُهُ تَعَالَى: فَإِنْ كَانَ لَهُنَّ وَلَدٌ
٤٩١٩ - وَبِهِ عَنْ سَعِيدِ بْنِ جُبَيْرٍ قَوْلَهُ: فَإِنْ كان لَهُنَّ وَلَدٌ: فَإِنْ كَانَ لَهَا وَلَدٌ ذَكَرٌ أَوْ أُنْثَى.
قَوْلُهُ تَعَالَى: فَلَكُمُ الرُّبُعُ
٤٩٢٠ - وَبِهِ عَنْ سَعِيدِ بْنِ جُبَيْرٍ قَوْلَهُ: فَلَكُمُ الرُّبُعُ يَعْنِي: لِلزَّوْجِ.
قَوْلُهُ تَعَالَى: مِمَّا تَرَكْنَ
٤٩٢١ - وَبِهِ عن عَنْ سَعِيدٍ قَوْلَهُ: مِمَّا تَرَكْنَ يَعْنِي: مِمَّا تَرَكَتْ مِنَ الْمَالِ.
قَوْلُهُ تَعَالَى: يُوصِينَ بِهَا
٤٩٢٢ - وَبِالإِسْنَادِ عَنْ سَعِيدِ بْنِ جُبَيْرٍ قَوْلَهُ: مِنْ بَعْدِ وَصِيَّةٍ يُوصِينَ بِهَا:
النِّسَاءُ.
قَوْلُهُ تَعَالَى: أَوْ دَيْنٍ
٤٩٢٣ - وَبِهِ عَنْ سَعِيدِ بْنِ جُبَيْرٍ قَوْلَهُ: أَوْ دَيْنٍ: دَيْنٌ عَلَيْهِنَّ، قَالَ: فَالدَّيْنُ قَبْلَ الْوَصِيَّةِ فِيهَا تَقَدِيمٌ.
قَوْلُهُ تَعَالَى: وَلَهُنَّ
٤٩٢٤ - وَبِهِ عَنْ سَعِيدِ بْنِ جُبَيْرٍ قَوْلَهُ: وَلَهُنَّ يَعْنِي: النِّسَاءَ.
قَوْلُهُ تَعَالَى: الرُّبُعُ
٤٩٢٥ - وَبِهِ عَنْ سَعِيدِ بْنِ جُبَيْرٍ قَوْلَهُ: وَلَهُنَّ الرُّبُعُ مِمَّا تَرَكْتُمْ يَعْنِي: لِلْمَرْأَةِ الرُّبُعُ.
