5262 - Muhammad ibn Sa'd al-'Awfi informed me in what he wrote to me, my father narrated to me, my uncle al-Husayn narrated to me, my father narrated to me, from his father, from Ibn 'Abbas regarding his saying: "And as for those from whom you fear nushuz (disobedience/rebelliousness), then admonish them," and she is the woman who is disobedient toward her husband. It is for her husband to initiate khul' (divorce at the instance of the wife) when the two arbitrators command it. This is after she says to her husband: "By Allah, I will not fulfill any oath for you, and I will not manage your house without your command." The ruler says: "We do not permit khul' for you," until the woman says to her husband: "By Allah, I will not perform ghusl (major ritual ablution) from janabah (sexual defilement) for you, nor will I establish a prayer for Allah." At that point, the ruler permits the khul' of the woman.
